How long does it take the officer to make a decision after a RFE response is sent?
I got a RFE on my EB2-NIW I485 asking for a Supplement J. Although I think it was a mistake by the officer my attorney insisted submitting the form so we just filed it last Fri.
How long does it usually take for the officer to check the RFE response and make the decision? My case has been pending for about 90 days now. I have a layoff coming up so I’m anxious. It’s Newark FO.

In EB2-NIW, there is no need for supplemental J.

You saying visa officer asked you to submit sponsor letter from employer on NIW ? I’m also waiting for NIW, just had biometrics last week. it’s so strange that how they can send such RFE which is not relevant to case.

For NIW, Supplement J is usually not required because NIW waives the job offer requirement, so your instinct may be right. But if your attorney chose to respond with one, USCIS may review it in weeks or months. A 90-day pending I-485 is not long. Because you have a layoff coming, ask your attorney whether the Supplement J could create confusion with the NIW basis.
