I have been so frustrated with this whole process,thank you for trying to help.. I filed vawa July 6 of 2021, on February 10th 2022 I received a notification on my uscis account that an RFE was sent to me, I never got it, neither did my lawyer, I went through my congressman, and recently through ombudsman, I have not heard back yet , and were are in June. I don’t know what to make of this Situation, was the Rfe update an error? 2nd I have a pending l765 based on a pending I485 filled in august of 2021, I am yet to be approved, do you think it has anything to do with the pending vawa? thank you for your response.

Hi @Jay jay. This happens a lot. it’s either they are still conducting a background check or waiting for a more senior officer to review your case. my case updated to approval after 1 year of interview. Hopefully you don’t wait that long, but you will get your approval.

my case is almost 2 years waiting and still waiting but at least i see some movements that 485 transferred from Texas to NBC and the notice stated that this is for a faster process 🍀 i hope i hear good news very soon

Hi @Veeee, have you tried calling them yourself?. If I was in your shoe, I will call and request to speak to a tier 2 agent. A tier 2 agent will inform you if RFE was sent or whether it was a system error. You should make haste and speak to a tier 2 agent. USCIS do not like it when applicants ignores an RFE. Regarding your i765; have you had your biometrics taken? it may have something to do with your vawa application, since you changed to vawa. Nevertheless, you need to speak to a tier 2 agent. I pray everything works out for you soonnest.

hello. my question is : few months ago we sent to them all tax return, income bla bla 2021 and they recived documents .last week they requested my husband to send them W2 or 1098 but my husband is self employer and hard to get 1099. and we are planning to write them an email to explain why my husband can not get 1099. and you think our case will be ok? im so worry 😥 Thanks for your help

@AO. unfortunately it does. You will have to be scheduled for a judicial oath ceremony. This is because USCIS does not have the legal authority to change your name and must ask a judge to do so. If your city has regular judicial ceremonies then there shouldn't be any delays. If your city holds regular administrative ceremonies, but not many judicial ceremonies, then the name change may cause a delay. in most cases, there is a delay since USCIS won’t swear you in, the judge would. it may take more time than expected.

hello. I filed DS-260 to petition for my mom. the last required document we needed to upload was her birth certificate. every column on the website says ACCEPTED so how do I know if it’s moving to the next step or if we still need to do something? they didn’t send a message when the birth certificate was approved or let us know that we’re going to the interview stage

@Louis K. Hi, the 2021 tax form you sent to them, what was the premise of your husband’s income on it? if your husband is self employed, they don’t expect him to have w2. I want to know how you all reported your husband’s income on the 2021 tax you filed. what document did you use to report his self made income ? please let me know.

@Sherly. Hi, if you rightly uploaded the birth certificate, then you have nothing to worry about and so far it was accepted. But, the best way to ease your mind is to log out. log in again and access your previously saved DS-260. Return to the consular electronic application website and select view/edit from the alien registeration section and and access that submitted application. if you were able yo sign and submit, then your application is good. you should wait for a notice via email confirming receipt, it’s usually on the same day.

@favour: we gave to them the federal form 1040 income tax return, transcript, proof of current self imploye ,bank statment about every income come in, and a letter to explain why can't get 1099 . Thanks your answer. what you think for our case ?

This might make no sense to you. Based on your AOS experience, how much longer do I have to wait for my 485 after having been approved for 765 and 131? I know this is an open ended question but I think I am just thinking too much with medical still about to be submitted. Thank you.

@louis. . 1099 is obtainable. you. I know someone who obtained theirs. it was ordered www.irs/form1099misc. I just want to know what form your husband filed when you guys were filing your joint tax. example. when filing joint tax, it’s either you have w2 (employed) or 1099 (self employed). together, these two generates into 1040. he must have declared his income somehow on the joint return you two filed. or did you all file using only one person’s income ? something doesn’t add up.

@pending I-485. in my personal experience. i received EAD April and was scheduled for an interview January the following year. you may also check processing times applicable to your state. Good luck.

I have a question I had my interview june 3rd. I received an RFe for my medical. I had it mailed and delivered on Friday. Does anyone know how long they’ll take to review it.

@A Lee. I know a couple this happened to. The other spouse also received the green card too. in their case, she received hers 2 months after the husband. she called USCIS when her husband was approved. She was told to wait. I hope yours doesn’t take that long, but that was what happened.

Hi @louise. just go to irs website and request for the transcript of whatever you filed and send to USCIS. your transcript is prima facie evidence of your spouse’s income. If you think this is not much. the best bet is to substitute it with a joint sponsor that filed their taxes using a W2. This is a separate form.

@jai Kelly., lol. it’s just Friday. If USCIS has updated your account showing they received it, you just have to give it a little time. I know someone who was approved after 3 weeks of responding to RFE. it varies. I hope you get approved soon.
