@Ann ly for my case, i was challenged by prong 2 and 3, in which my lawyer and i drafted the response by clarifying my intention to continuing doing research in more specific terms. Also i had to prove that my research had significant interest from world wide researchers. Your case will be different so don’t worry too much about it. Your lawyer will draft the strategy with you.

@Huy Tran so it took you 60 days for the approval, you didn’t pay for premium process. I’m a nurse so I dont know what evidence they will ask for my case I still haven’t received my RFE letter yet Thank you for your response

@Ann ly it was april 2022 when i submitted my rfe response; and uscis announced premium processing for i140 on july 2022. So… it didnt make sense for me to pay premium processing at that point since it was already 60 days into it. It was a miracle that they responded on the exact 60th day! @Ann ly my i140 was filed with texas center. i485 was directly handled by NBC as all cases recently would be

l@Ann ly i imagine you are not submitting as eb2-niw, but only casual eb2 with PERM haha. Unless there’s a research position for nurse that im not aware of 😆 If so then you must be working with your employer’s lawyer then, I guess 🤔

@Huy Tran oh my is EB3-Skilled for nurse so I do see some cases was really quick around 2months to 4 months but some cases do take 1 year to get GC approved

@Ann ly i see. This post was with eb2,eb2-niw so that’s why im confused with your case haha Nurse eb3 should be very straightforward, even if you have rfe. Do you pay premium as well?

@Huy Tran yes my agency paid premium processing and I read with premium processing they will have to answer my RFE submission within 15 days
