I was F1 with OPT after I graduated college; but once the OPT expired, I had to apply for TN Visa at the consulate. While working with OPT, my legal status was F1 + OPT, if that makes sense? hope this helps

@Nurse A.S thanks for getting back to me , did uscis ask you proof that. they asked proof of my stay , I became nurse in 2021 may , continued to take in class until 2021 while waiting for my work permit , work permit issued on august 2022 so stop going in class and started working upto will this have violation on my case ?

@eve kibsogeno in my personal experience, USCIS did not ask of proof of it and it didn’t affect my AOS case. But if they’re asking, you could show them your I-20 that should state you’re under F1 with approved OPT; which allows you to stay in US, have EAD and work under F1 status. Once I graduated, I took my NCLEX and started working, I never went back to classes even during my OPT. However, every case is different unfortunately, you might want to consult a lawyer just in case.

@J A I filled January 2022 but got approved for work permit in august

Ohh thats where the RFE is all about because you stop going to school until 2021 the moment you filed for adjustment you might not have been eligible.

@J A I was still in school in while I file my AOS, I stopped going to school when I got my work permit and GC pending

If you were still in school then you should have enrolled by fall semester because you stated that you were a student until aug.2021 but when you filed for AOS you were not a student anymore because you did not enrol until you filed for Jan.2022

@J A I think I was suppose to say I was enrolled to 9 credit hours until august 2022 , when I received my AED in august I did my go back to school , I enroll online and started working , will that have any issue

The issue there is that you only enrolled 9 units of credit when you need to enroll a minimum of 12 unless that is your last semester. Second, as far as I know only enrolling on online classes only does not count as you need to enroll 9 units of in person class and 3 units of hybrid/online classes. Third, it does not really matter if you enrolled until aug.2022, the question is are you still “on status” with your student when you filed your AOS, if you only had 9 credits and all online classes on the day you filed that AOS then thats the problem.

@J A yes I was on status when I filled my AOS , my only concern was , was I need to continue with school until I get my green card, being international school school is expensive so I could not keep up going to school since tutution was expensive, at the time I stopped I enrolled class my DoS that’s the international school affairs told I can choose to stay in school or start working

You can start working pending AOS. We have the same case I am also a nurse and pending AOS and also an F1 visa before

@J A yes I was full time student fall 2021.spring 2022 too, did you stop going to school after your pending AOS, I don’t know why they ask me that ,I can give you my home number so you got me up or instagram if you don’t mind and catch up there

yes i stopped. Im asking if you only enrolled “online” only fall and spring because if thats the case then it might be the reason for your RFE
