Help!
I have a pending asylum which I withdrew because my NIW was approved (huge & expensive mistake, I know but I was misinformed and only just learned of this app today💔🥲), I only just realized I might be out of status while trying to file for adjustment of status as my priority is current. Has anyone been in this boat? please advice and encourage me. I have an attorney appt tomorrow but my PTSD is kicking me so I need to read something to lift my countenance. I’m thinking reinstating the asylum case but can I still readjust my status?

Only the attroney could advise you better. The only thing I could say is that if you have been out of status for less than 180 days, your lawyer will be able to find a solution. So keep calm

@ABC def Well, there’s always a way! First do everything and try to reinstate your Asylum and have it approved! otherwise it’s only going to serve as a “Lawful Right to stay”. Save your I-140 approval, and when you get you “Status Granted” through your Asylum, apply for the I-485 based on your approved I-140. So, good luck and see every option available, and make it happen! cheer up!

is it faster to get i485 approval through NIW? how long does NIW take to get approved?

@ABC def did you withdraw before applying for I-485? how many days of gap now? I think if you are not out of more than 180 days, you are good I think, talk with the prof lawyer.

@Zack Alim unfortunately I did. withdrew it in April 🥲 I had no clue. I thought I can’t have more than two applicantions concurrently 💔

@Zack Alim I haven’t applied yet. im concerned it would rejected due to the unlawful presence clause.

@ABC def Consult with tye lawyer and try to submit as soon as you can I think. But good thing is you are not over 180 days so maybe you need to submit some kind of waiver I don't know.
