Help!!!
Hello, I filed an i-130 for both of my parents as a daughter since I am a citizen.
They both got approved for that so we got excited and went to the next step.
We did the medical exam and seen a civil surgeon and filed the i-485 but months later they were both denied for the i-485.
and then weeks later they were asked to do a biometric / fingerprints. Does that mean their case is open if they're still getting requested to do things or do they have to reopen their case since they were denied initially?
As for the i-134a that's a separate issue that I'm still waiting on over a year later for 3 people that i have filed! There's no time frame and the USCIS inbox isn't being very helpful either.
Are there any free affordable Advocates I can add on to my case to help my family? We are in dire need of assistance because it is very hard for employment and their environment isn't safe. I pray that they can get approved soon.
Community please help!

wishing you the best as well. I think you need to address the reason for the denial with an expert… did you have a letter? i’d ignore the fingerprint thing. that’s probably just a robotic thing on their cases.

@Ashley Laborde what is the reason for denial?
Ashley LabordeFeb 1, 2024
I've tried reaching out to many immigration lawyers but they ended up taking my thousands of dollars and have been no help.
But since they have been denied we'll probably have to reopen the case but I don't know any experts to go to. Would my parents have to redo a medical examination with the Civil surgeon or can we just reapply for the same I-485? If we do reapply what are the chances that we get approved or denied? I have so many questions and this process is very stressful and not guaranteed for many families 😔

girl we don’t know why they were denied. you need a lawyer or to tell what’s going on if you want help

@AshleyLaborde, i discovered this attorney who answers immigration questions on YouTube immigration answer show. He gives free legal advice if you call in with your questions. check it out. I have never personally used his service but he seems to have great advice.

Ashley, did the provide a reason for the denial?
Jowi OchopoFeb 2, 2024
Sorry for your predicament. But until you state the reason for the denial, you'll get very little help here. Best contact a good lawyer.

Apparently they are saying the Form I-485 is denied based on lack of USCIS jurisdiction. 8 CFR sections 245.2(a)(1) and
1245.2(a)(1).
(Whatever that means)
You may not appeal this decision.
If you desire to file a motion, you must do so on Form I-290B within 30 days from the date of this notice .
The motion shall be filed on Form I-290B, together with the current fee, and mailed.
So maybe re-opening the case might be the proper ideal but I feel like it would be a waste of time if I redo it again just to get denied for the same issue.
so how do I Target the issue?

If USCIS say they lack jurisdiction on their AOS, then it may mean your parents have an immigration case before a judge, therefore, it is the court that has jurisdiction over their AOS. Could that be the problem?
Ashley LabordeFeb 3, 2024
I believe so.
How exactly can I solve this problem?

Does anyone know where I can get free legal assistance?
