Hello Lawfully Family! Your insights and advice is needed.
On June 10th I received an email correspondence from my previous attorney ( The attorney that I had a retainership agreement with while I was married to my ex) and the content of the email was an i-130 denial decision dated June 7th 2024 i have initially received the said denial notice after my unsuccessful interview. ( i-130 filed in September 2018 with other necessary forms as required by the process). Again today I received another correspondence dated June 8th 2024, stating that i-130 was re-opened. I have since divorced moved on and filed vawa which my i-360 was approved February 2024, and I have a pending i-485. Please what could be the reason for the re-opening of this i-130 while I am no longer married and I am waiting for a decision on a pending i-485 after my vawa approved in February 2024. What could be the reason and how do you guys advice I address this?

There is nothing to worry about. The application of I-130 is a forgotten issue to you. I-130 wasn’t filled by you, but your spouse. You are good and focus on your I-485 approval

Here is my experience, my ex submitted I-130 and I-485 sometimes in 2016. we went for interview in 2017 but the officer was mean for no reason and didn’t approve us nor sent rfe. I kept renewing EAD/AP. They sent notice of intent to deny sometimes 2020 during the lock down. we responded to the notice within the time we were given but I believe they didn’t receive it on time(guess that was due to Covid) and about 2 months after sending back our response, both the I-130 and 485 was denied. I just left everything because I was already having issues with my ex. 4 months after the denial, I got a notification that I-130 has been reopened (I didn’t do anything). 2 months after they reopened the I-130, I approached my attorney and we put in vawa and 485. 3years after they approved my vawa and I’m waiting for 485 approval now. the I-130 still have the same status till date “case reopened”

@tuff gong uscis can be weird sometimes. My ex withdrew the petition in July 2020, but then they sent me notice of interview for December 2020. My lawyer advised me not to go, which I was never going to do anyway. If I'd gone they'd hold onto me there. Sometimes people don't update the system on time or properly so if the case moves to another field office, they might not realize that the case was already done with. That's my guess, anyway. I'd say ignore that notice. You're already almost done with the vawa one anyway.

I agree with @Kerry S Ignore the I-130, it was filed by your spouse and not you. @tired from waitingg what do you mean by denial code? I just know they listed about 5 reasons why they werr going to deny in notice of intent to deny. about 4 was based on the questions they asked during the interview. we were seperated from the beginning of the interview. questions like the name of our apartment management. I mentioned the old company while my ex mentioned the new one because they just changed the management at that time. I didn’t know the change had gone through, another question was what update is being done in our apartment, I mentioned general update, ex was specific listing kitchen update, bathroom update etc, so they were things my attorney could defend and we responded but they ended up to deny and reopen on their own. can’t remember the major reasons on the denial letter. it’s been a while

I want to say am immensely grateful for this community of beautiful souls. Thank you all for sharing your thoughts and advice. I did thought about it as that it's best to ignore it. And also could that means they reviving my i-485? as @mcy🙌🏿🙏🏾🙏🏾💕 grl have stated? even though I have not seen any progress or changes on it since my vawa was approved in February.

@F A Exactly same thing happens to me i am still have my i 485 case was reopened and my i130 in withdrawal , and waiting for my i485 interview

@F A same thing happened to me my denied case has a code which indicate my wife withdraw her sponsorship during the interview so it was Ina 245(a)(3) that time i become uneligible for gc that is why I am asking what was your code cuz that code on my denial can be fix with vawa but some code refer like fraud etc can not be fixable unfortunately
F AJun 18, 2024
@tired from waitingg I get what you mean now. it was denied because i130 was denied. I don’t know what reason was stated on the I130 because my ex received it. But I’m sure it wasn’t about fraud.

@F A hope nothing related to fraud what your lawyer says? we should keep in touch here we are in same boat🙏🏻 hope one day we will get gc your vawa approved at least this is good mine still not
F AJun 19, 2024
@tired from waitingg my mistake there. I’m meant to say nothing related to fraud😀. I just edited it. Sure, let’s keep in touch. we will receive our good news soon🙏
