Legislation entitled the Adam Walsh Act1 which was passed in 2006 imposes immigration penalties on U.S. citizens and permanent residents who are convicted of certain crimes against minors. A U.S. citizen or permanent resident who is convicted of a “specified offense against a minor” may be prevented from filing a visa petition on behalf of a close family member. If the petitioner is a permanent resident rather than a citizen, the person will be referred to removal proceedings to see if he or she is deportable. “Specified offense against a minor” includes offenses that are not extremely serious, such as false imprisonment. It is defined as an offense against a victim who has not attained the age of 18 years, which involves any of the following acts. A state offense must be substantially similar to the federal offenses in the definition. 2 (A) an offense involving kidnapping, unless committed by a parent or guardian; (B) an offense involving false imprisonment, unless committed by a parent or guardian; (C) solicitation to engage in sexual conduct; (D) use in sexual performance; (E) solicitation to practice prostitution; (F) video voyeurism as described in 18 USC § 1801; (G) possession, production, or distribution of child pornography; (H) criminal sexual conduct involving a minor, or the use of the Internet to facilitate or attempt this conduct; (I) any conduct that by its nature is a sex offense against a minor

yes, the Matter is that uscis is still investigating and they will know that my husband is not a risk to me and he is not a bad man. Uscis can approve my case or reject it, all depends of what they look for, but my husband has never been a bad man and I can be witness and many people about this.

Hi. Does anyone have any updates on this? I have a pending AWA case. I have my work permit and travel permit. However, USCIS keeps cancelling our interview schedule. They cancelled on us twice. We filed in August 2022.

awa case denied in 2019 initial filling. 2018, refilled again with awa exprirnced lawyer january 2022, husband did fingerprint nd more evidences request in March 2023. online case update actively review. my i465 actively reviewd too. but no EAD yet. i will be approved this year january 2024. amen we shall all be happy at the end. amen

I have a criminal background, sex sting operation via adult dating app, i am still waiting for my wife I-130 for 1 yr and half. No update yet. She was not aware of my case. @shanna love unfortunately not. Our cases are quite unique and sensitive. I solely rely on my lawyer. I have used my travel permit and it went smoothly last year. There’s a lot of misleading information out there. please let me know if you ran into some solid group.

@Believe Believe omg really? my fiancé case was that he committed the act when he was underage but speak to a school therapist at 17 and he told her what happened and she reported him to the police. he wasn’t convicted and did a plead. do you have anywhere we can stay in touch? when did you start using this lawyer?

Hello everyone! I am in the same situation with Adam Walsh but we haven’t filed the waiver yet… I would like to know if while the waiver is being processed… are you allow to get a work permit ?

@Jupina Arepi you will get a work permit while the cause is being processed. My lawyer applied a work permit and advance parole at the same time so I could visit my family outside of US. My case does not have any children involve in the petition. My kids are born in the US where I met my husband. Good luck!

@bebe lele I am not sure. How long have you been married? I’ve been married for 15 yrs. This is our second filing. The first time we filed was right after we got married, no lawyer, no kids, and just trying to prove ourselves. Of course USCIS didn’t just take our words. This time around, we refiled in 2022, with 2 kids and a lawyer. Also, my husband petitioned the court and he is no longer in the registry. I am not sure if that is relevant.

@bebe lele it was denied and they cancelled my work permit at that time. it was back in 2009. We appealed our case without a lawyer and still got denied. I didn’t get any removal proceedings, my case is not that important compared to other immigration cases that involves criminal histories. I was very careful in terms of driving, work, and other activities(I had a drivers license since CA allows you to have one). I guess I was lucky. The thing with Adam Walsh waiver is that, the US citizen petitioner needs to prove to the USCIS that we (beneficiaries of petition) are safe in their presence.

@ponpon baggio hi. Yes, I received my work permit last year. It is a combo card that allows you to travel outside of the US and lets you come back.

Hello there I commented on this thread a couple years ago. Have a similar case my husband got convicted when he was 19 years old now he is 40 will be getting off the registry this upcoming year. We filed in sept 2023 and still awaiting to get the combo card. We have everything prepared for when we get the denial. Anything that can help us add to our package. I’ve also seen many people hired Allan Lolly whom is our lawyer as well. Any updates on whoever case if they have got approved. Would like to keep praying and hoping for a miracle everything turns out as we hoped for.

Received NOID notice and after submmited in 2 months , case was denied. Asked my therapy wasn't specific about sex offender treatment and if I overcome those goals even tho I had assigned from court treatment, will wait 3 months and do refile. ITS BEEN 9 years with 0 violations still cant live my life with my wife

@neel shah similar case same timeline. we’ve been in the process for 3 years initially filing Mar 2022 but total 5 years together, we submitted the noid documents in Oct24 and received a denial in December24. the reason was because my recommendation letters and family character letter of me didn’t state my offense. like they didn’t rant about the difference I made from the past ten years which should tell them they’ve known me of course some letters from family that help me at that time, they know exactly what my cases are about. doesn’t mean they will shout it from a mountain top and express in detail through out their letter. I am praying with legal help I can reapply and fight it again hopefully with a stronger package..
