green card thru marriage.
I have a question about my case, see if anybody can help or have been thru this. So we applied for my husband form |130 alone, back in 2020. that’s the only form we filled because we weren’t sure if we should send everything together or not (we did outselfs) anyways, fast forward to now. we just got an interview date which we are super excited for. it’s next month! it just says “interview scheduled for form |130.” interview is last step correct? what I’m wondering is, can it be approved and him get he’s green card just with that form? or do we have to file |485 after? and has anybody done it this way? and if yall has, did it take long for it to be approved and for you guys to have your green card? we have been waiting for 4 years already on this and just can’t wait to have it done so we can visit our family together. I am a USA citizen but I’m also from Brazil, we both are. Should we go ahead and fill out form |485 and take it with us for the interview or no?

if I understand this correctly , your husband came here on some type of visa and you got married, after getting married you filed 130 for him, did he go back to his home country or he stay here with you without filling 485

fill out the i485 and i765 and submit it via mail with a copy of your I130 receipt.the cost is $1225
i130 is not for a greencard so they won’t issue one

@Mellica G do you think I should wait for the interview and do it after or if I do it now would speed up our case on the day of the interview? our interview will be in Montgomery, do I fill everyitng and just send it there with a check?

@Mila H. so since we have been married for almost 4 years we don’t need to apply for the other forms and the |130 will do it? is that what you mean? he’s already in the USA and living with me. if that’s it, then awesome haha I’m even more excited I was just worried because everybody has done all the other steps and I didn’t know if we should go ahead and do it before interview or just wait. thanks for anwering.

@Mila H. He’s not legally. he overstay he’s welcome and we just met later on. i think a bit more than 6 months he stayed here before we got married and filed.

@Gabrielle silva it could speed up the process but you cannot mail documents to the field office. you will have to mail it to uscis lockbox for cases from your state. they will sort it and assign it to an officer then transfer it to the field office.

@Mila H. you are giving incorrect information. he doesn’t automatically gets green card with the I-130 he needs to file I-485. I-130 approval just mean they recognize the relationship between both parties. they do not need to file waiver as long and she is a citizen because you’re automatically forgiven if your petitioner is a USC. I did mine completely by myself. I file con-currently and I had overstayed since 2016 and I filed 2022 November and got my 10yr 2023 June.

you need to just submit I-485 to your respective Lockbox. you CANNOT take it to the interview with you.

@Mellica G she is giving this poor lady a freaking bad advice. I hope she don’t listen to her. I did my process myself and I filed concurrent. @Gabrielle silva this is what I filed- I-130, (I-130A(information about the beneficiary) ,I-131(travel document), (I-485 -AOS must file if present in the USA) ,I-765 (work permit),
I-864 (affidavit of support).. I didn’t include my medical in this package so they request it.

@Jamaican princess 🇯🇲 thank you so much! I already knew I didn’t have to file the waver so it’s all good. We are probably gonna wait to go to our interview it’s going to be on Feb 22 (not that far anymore 🙏), and then after we will take care of the rest.. they will probably give us more information so it will be easier to know where to go from there. @Lena P yes he can as long as the petitioner is a USC. I overstayed from 2016 n I filed concurrently. if she was a permanent resident then he would’ve had to submit before he is out of status. i got my 10 yrs within 7 months of filing concurrently

I overstayed- I did concurrent filing. you can still do concurrent filing even if you overstayed there’s no restrictions.
but if you filed i 130 first and it’s been approved the next step is to adjust his status i485 and apply for work permit if he’s not working that can be put in together with AOS
your paperwork will include i485 i765 and supporting documents for each form

@yes you can after he becomes a USC. just submit a copy of his certificate showing he’s a citizen
