can you explain more on what reason make you have to get greencard on immigration judge ..is it a apeal case
Jenn PAug 31, 2021
these person was on removal proceedings meaning deportation but he marry a us citizen when someone is in removal proceedings no matter who u marry u can't just apply for your green card with uscis, first u apply for the i130 with uscis then after u get approved you go back in front of the judge to apply for i485 and i765 then after that the judge will interview u n your spouse and then decide to deny or approve your case. after he approved the case I know u get the green card in about one week or 2 buy I don't know how far long the hearings will be because after u summit your documents the judge will schedule u for another hearing for the interview so I wanna know the length between the submitting document to the decision hearing

The case I know is someone was married with a green card holder, the guy was married for 10 years but never submitted any application. Then they filed for divorce because the guy had alcohol problems and anger issues. They had 2 kids, but one of the kids has health problems ( constant seizures). The guy was on removal of proceedings because he had a street fight, a judge decided to not deport him but he didn't decide to give him the green card right away, and decide to see him in 5 years in court to see how he was doing. During 5 years he got Work Permit, 2 months before going on court the guy had a DUI and drivers license suspended, at the court a judge decided to give him 2 months in prison but when he served those 2 months, ICE when to the prison and picked him up to inmigration jail again in removal of proceedings. He went to court and the judge granted him probably because of his sick kid or who knows the reason the judge decided to give him green card. He received green card 1 month later after he was granted.

oooh well that case is different the person didn't do anything except that he overstayed his visa that's why he is in removal proceedings but no felony or anything during his stay here. and when someone is in removal proceedings it doesn't go away until u get a green card u can have work permit and still in removal proceedings the judge just put the deportation on hold or pause. even if u marry a citizen u would still be in deportation proceedings until the judge decides to grant you the green card

how long was the process from the Time u applied to the Time it was granted
Jenn PAug 31, 2021

Jenn PAug 31, 2021

Jenn PAug 31, 2021

Jenn PAug 31, 2021
but at least you was able to work and travel some people don't get that they just get a work permit until they can get their green card

wow i didnt know that you can get to the point of removal proceedings on tourist visa. i have never known anybody on b1/b2 who overstayed and got removal proceedings or deportation
Jenn PAug 31, 2021
yup once u overstayed your six months u out of status that means u are deportable. they can't just put u on removal proceedings if they don't know where u live or anything about u because they'll need your address to send to the notice to appear to court but once they find your address somehow they'll serve u. my friend has been here since 2015 they just send him a notice to appear after he send in his application for TPS it's like they was waiting for him to send in something so they can send the notice. but if it was a green card application he did sent in they wouldn't put him in removal proceedings
Jenn PAug 31, 2021
so now he has to appear to court even though he has a pending TPS application if it's approved they won't be able to deport h now so they'll put the deportation on hold until his tps expires if he don't get married or try to change his status before that then the deportation won't stop just because he has a temporary protected status. it'll stop when he become a permanent resident

Louriz N.Aug 31, 2021
oh right, okay. filing TPS triggered the deportation.
Jenn PAug 31, 2021
I don't think it's the tps he had applied for asylum when he first got here and it was denied but they never sent him anything else after the denial letter so he thought that they forgot about him or case was close until now when they give tps for Haiti he applied and a week after he applied he received the notice to go to court and now it's not easy for him to get a green card even through marriage because once u are in removal proceedings u get married while u are on it they don't think the marriage is real that's why u can't apply for your green card through uscis just like everyone else he has to apply in front of a judge and he'll have to prove that his marriage is real after several hearing the judge with decide to denied or grant him the green card. the process will take about 3 years or even longer
