Green card documents
Hi All, I would like to see if I have all the documents that are needed for a concurrent filing before I have them checked by an immigration lawyer for content. Background - UK citizen, married to a US citizen, in the USA on a B2 visa. Form I-130 (Supporting documents, passports (proof of nationality) spouse birth certificate, my birth certificate, my previous divorce decree, current marriage certificate, 2 x passport photos, proof of relationship - photos) Form I-130A (Supporting documents as above) Form I-131 (Supporting documents, letter from a company of which I am a director expressing the need to travel to company projects in specific countries, signed by the chairman) Form I-765 (Supporting documents, none) Form I-864 & I-944 (Supporting documents, 6 month bank statements (spouse and mine), Investment account balance statement) Form I-485 (Supporting document, UK police certificate and subject access request, 2 x passport photos). Is there anything I am obviously missing? Thank you in advance

one of my friends just got an RFE for his birth certificate, he is also a UK citizen and apparently your certificates barely contain any info, so they asked him for detailed one that he has to now provide. just FYI :)

For I-130 just photos as proof of the relationship are not enough. USCIS want to see that you live together (joint lease/mortgage, utility bills, driver licenses with the same address) and that you merge finances (joint insurances, bank statements, etc). Also good to include written statments from family or friends where they state that they know both you and your spouse and that your marriage is real. My lawyer advised me to include at least 2 proofs of each type + 20 photos. For I-130A you need to include a copy of I-130 For I-944 you are missing credit report, tax transcripts for the last 3 years, 12 months of bank statements, proof of health insurance in the US, your education documents For I-485 you are missing current I-94, copies of all your US visas and any other status documents if any (like I-20 or DS-2019 for students, etc) For all forms you are missing copies of your passport and birth certificate You might miss something else which I didn’t mention above.

Thanks Oct'20 We do not have any of those joint things, my wife is a medical student with bad credit so the house lease is in my name, as are all the bills. We could get a joint bank account though with no issue and of course statements from the family. For I-130A Copy of I-130 even if filing all in one package? For I-944, I do not have a US credit report, tax transcripts or health insurance. My health insurance is from the UK. I can provide 12 months of bank statements but no tax information. I also have copies of my degree certificates from the UK. I-485 - yes current I-94 I have, will include my current B1/B2 visa copy also. Do I need to provide a copy of my birth cert and passport for EVERY form even though I am applying as one packet? Thank you for your help

Each of your forms should be standalone. Most likely your forms will not be processed together, but will be separated and processed by different officers. For example I-485 and I-130 will be sent to local office and I-131 and I-765 will be processed at big service center. That’s why it’s best to include all necessary documentation in each of the forms even if it’s duplicate. Otherwise you might get RFE and processing time will be longer. Regarding some of the documents that you don’t have — I don’t know what to do. There is a high chance that you will receive RFE later if you do not include something on your initial package. If I were you I would consult a lawyer and see what are the alternatives. For example, instead of credit report you can get a statement from a credit bureau that you don’t have one, etc.

Oct'20 Thank you again for the great advice. I believe I have all the base information in place, and there are just the more awkward outstanding ones which I will go through with a lawyer!

hey @alec Time. still waiting on my I130. I tried to expedite my i131 and took biometrics last week - still waiting on everything else

Maybe we can get in touch some time of the app! Would be great to see how our time lines go on.. I didn't get a biometrics appointmenz but I guess this could be as I had a f1 visa previously.. Do you know if the London Embassy is open?
