Got approved
I have a pending asylum case which I filed since 2018. prior to filing this, I was on F1 status which unfortunately was terminated due to my inability pay school fees. So I filed for asylum and have started working with EAD since 2019. Since filing the asylum in 2018, my case has not been adjudicated. However, recently, I filed for NIW/EB2 which I got approved for luckily. Now I am supposed to file for an adjustment of status (I-485)or travel back home to go through a consular process which I think is dangerous. Applying for adjustment of status here in the US also has its own challenges because of the fear of not having a non-immigrant status at the moment and for the fear of not being sure if I accumulated unlawful presence between the time my F1 status was terminated and the time that I filed for asylum. I am so confused right now and don't know what to do. please, has anyone been in my shoes before? If so, how did get out of the situation then?

Hi, @SD maybe you don't need to go back to your homeland, you can do your interview here in the US. so If I was you I definitely follow the NIW/EB2 case. It will be pretty much better and faster to get your greencard.

I am aware and also prefer to adjust my status here, but the question is am I qualify for it based on those issues I raised. you know, not everyone is qualified to adjust status?

Its a little bit complicated as the adjustment of status needs you to be on a non immigrant status which the asylum was not yet adjudicated. I would suggest to talk to an attorney as your case is quite complicated

@fay h Let me first say congratulations. But again, your story is not clear to me. I-290B is approval for an appeal, so what did you appeal for? will you please share your story so that someone can learn?
