Going back for rentry?
Hello good people
i am asking this for a friend
Her mom filed for permanent residence for here. By then my friend was not in USA.
Now, she gains admission and she came to the USA.
UScis approved her mom’s forms and tells asks daughter (my friend ) to apply for adjust of status.
uscis upon realizing she is in this country says she has to go back and apply through her country of origin even though she entered USA legally for school. she has a lawyer and this lawyer is not helping
has anyone ever been in this situation and is there any way out?

If your friend is over 21 then she needs to leave the country and wait for her filing date to be current then apply for immigrant visa and return

Depends on the filing date that’s current and her place in line

her mom applied long ago
its been years

the exact time when her mom applied for her is very critical in advising her in this case. This can be found on the receipt (I-130) or approval letter as Prioirty date.
