#Foodstamps
Why are there so many people especially lawyers making a deal about being on foodstamps when petitioning for family, it's clearly stated in the USCIS policy manual that foodstamps is NOT an issue. So does the actual foodstamps website say as well. Do you know anyone getting a NOID or denial letter because of Foodstamps?

Before Trump, it wasn't a problem. The first question the officer asked me was if I'm on food stamps. I said no, and he said "good." My father got noid; he had to find another sponsor besides his wife.

I donโ€™t know, but from my perspective I wouldnโ€™t want people that are on government assistance bringing in people they canโ€™t support or canโ€™t support themselves. that makes zero sense

@w s ๐Ÿ‡จ๐Ÿ‡ฆ๐Ÿ‡บ๐Ÿ‡ธ so find a joint sponsor. sponsoring spouse being unemployed isn't any worse

@God in control cash assistance is a big problem, that's one of the 2 things that's a problem to be on. However that isn't necessarily mean you'll be denied, there's other factors to it. You will have to write on the I-485 though that you received cash assistance

Medicaid federal or state is totally fine

@in the Jesus name amen the noid said because of Foodstamps?
G
Green buzzJun 19, 2024
that's clearly against the law, they aren't able to reject someone due for foodstamps, officers don't make the law, they have to follow the policy manual.

they can get sued
K ๐Ÿ‡น๐Ÿ‡น๐Ÿณ๏ธโ€๐ŸŒˆJun 19, 2024
@Green buzz umm , they can deny you.. that's why there is an affidavit of support .. lol

@K ๐Ÿ‡น๐Ÿ‡น๐Ÿณ๏ธโ€๐ŸŒˆ did you read the manual policy? The process of immigration isn't logical, it's based upon very specific laws. according to the law they can't deny you because of Foodstamps. affidavit of support is only for cash assistance and long term hospitalizations.
K ๐Ÿ‡น๐Ÿ‡น๐Ÿณ๏ธโ€๐ŸŒˆJun 19, 2024
@Green buzz I did but why support bringing someone here if you are on food stamps that's wild ๐Ÿ˜‚

@Green buzz - Actually this is what the actual law states about the affidavit of support. ***Please nobody let a random stranger on the internet try to scam you into filling out your immigration forms. This is your personal information. Form I-864, Affidavit of Support under Section 213A of the INA, is a contract an individual signs agreeing to use their financial resources to support the intending immigrant named on the affidavit. The individual who signs the affidavit of support becomes the sponsor once the intending immigrant becomes a lawful permanent resident. The sponsor is usually the petitioner who filed an immigrant petition on behalf of the intending immigrant. An affidavit of support is a legally enforceable contract, and the sponsorโ€™s responsibility usually lasts until the family member or other individual either becomes a U.S. citizen, or is credited with 40 quarters of work (usually 10 years). The law concerning the affidavit of support is found in Sections 212(a)(4) and 213A of the Immigration and Nationality Act (INA). The provisions are codified in Title 8 of the Code of Federal Regulations (CFR) at 8 CFR 213a.a

@K ๐Ÿ‡น๐Ÿ‡น๐Ÿณ๏ธโ€๐ŸŒˆ why is it wild? because I have no money, my spouse can't live in the USA?
K ๐Ÿ‡น๐Ÿ‡น๐Ÿณ๏ธโ€๐ŸŒˆJun 19, 2024
@Green buzz with all due respect , if you not meeting the financial requirements and on food stamps you DEFINITELY should not be voicing an opinion about law markers not bending the laws for other people to bring more ppl here to live off of PUBLIC BENEFITS worst yet you even trying to be a self proclaimed lawyer on this app is CRAZY ๐Ÿ˜ซ For a fraction of the price

some of these comments are upsetting. so what someone is on food stamps. Does that mean they canโ€™t be with the love of their life? eventually the spouse will be able to work and bring their share in the home and maybe the family wonโ€™t need to be on food stamps in the future.

@Patiently Waiting what about if your USC spouse on SSI disability because of health issues but you have good joint sponsor and plus Beneficiary spouse work 40 hours a week and pay all and support there USC spouse financially. there is any issue please I need advice,
P
Patiently WaitingJun 19, 2024
@Singh USA ๐Ÿ‡บ๐Ÿ‡ธ - If you have a joint sponsor that can prove they can support the beneficiary then you should be totally fine. Unfortunately the beneficiaries income doesnโ€™t count, itโ€™s all about the sponsor.
S
Singh USA ๐Ÿ‡บ๐Ÿ‡ธ Jun 19, 2024
@Patiently Waiting why not if work permits approval Through the pending I-485 then beneficiary income need to be count and I file Tex jointly with USC spouse,I mean that is plus points right ,
P
Patiently WaitingJun 19, 2024
@Singh USA ๐Ÿ‡บ๐Ÿ‡ธ - No it doesnโ€™t count period.
P
Patiently WaitingJun 19, 2024
@Singh USA ๐Ÿ‡บ๐Ÿ‡ธ - These are the rules and they donโ€™t bend them for anybody. They give the beneficiary a temporary work permit so they donโ€™t become a tax burden while theyโ€™re waiting on a decision.

@Singh USA ๐Ÿ‡บ๐Ÿ‡ธ income from the immigrant does count at times with some conditions, read the rules on the I-864 and read the USCIS policy manual
G
Green buzzJun 19, 2024
@Singh USA ๐Ÿ‡บ๐Ÿ‡ธ your paying taxes because that's the law. it's not connected to immigration.
