FOIA REQUEST
Hello Vawa Family, is there anyone who requested their case file from UScis?if so, how long did it take ? my attorney made a request a month ago, we are yet to receive the file ,and for the reason why we made a foia request, I received a notification on the app in feb of 2022 for request for evidence, I never got any letter online or in the mail , reached out to ombudsman/congressman for help, they only responded with case is processing within the normal timeframe, which makes no sense, so was the update an error? That was the reason for the file request. has anyone experienced such? what was the resolve? Thank you so much .

I’m not sure why you are submitting a FOIA for an RFE that you did not receive based on your current USCIS case. I’ve requested FOIA but it was for BP which took 4 months. I don’t understand why you did not submit an inquiry to USCIS. It says on the status that if you do not receive the RFE prior to a date then you should inquiry by submitting it electronically. best of luck to you.

@remain anonymous I submitted an inquiry 2 weeks after the initial update, they updated it was assigned to an officer, and updated it was completed afterwards, that was why I sort for help from the congressman, please read to understand

I had almost similar problem. I provided the wrong house number, and the RFE was returned to them. Luckily, the address didn't exist. I only found out after I hired a lawyer and he requested the FOIA and then I had the receipt numbers. The RFE letter wasn't included in the FOIA, so he had to send an email asking immigration for it after I amost begged him. Only then did they send a copy. They only resent the original letter after two years for me to respond officially. I don't remember how long it took to receive my FOIA, but if your RFE is not in your FOIA, your lawyer can contact the VAWA unit by email and request a copy, and after while the uscis will resend the oficial rfe again (in my case uscis resend because I talk with my congress man) my case already 34 months . feel free to ask something.
