@Mel W I am almost in the same situation. Almost, because I am not divorced yet. I am separated from my wife, and at some point my n-400 status and my I-751 is pending for 14 months.

@Mel W Considering your situation, I could get a divorce and file for divorce, that's what I think is best. Anyway, I'm not with that person.

@Luis Ortiz you need to withdraw your N400 since you will not be eligible to apply based on 3year rule. However, it’s possible to convert you jointly I751 to divorce waiver.

@Verah Ans I have been a resident for 6 years. I had a first I-751 which I lost because I didn't go to the interview. I lost that one and some others.

did they cancel your N400 after u changed it to waiver- coz I have seen few people who applied N400 on divorce waiver got @Mel W approved with their citizenship.. they didn’t get any crazy questions at all.

I asked them to withdraw it because it was based on marriage (3yr). they confirmed withdrawal and cancelled my interview. I’ll apply again next year. I didn’t want to take any chances @a v

@momm momo not sure you got a response to this but it really is just another way of filing. you can simply write a letter to uscis, the same office processing your case with your case number and let them know you want to switch to a divorce waiver. they will likely send you an RFE asking for the divorce decree.
