Filing Taxes
I am the petitioner (US citizen) and still waiting for UsCIS approval PD April, 2023. I am almost ready to file my taxes and don’t know if how I file could affect us in anyway. My options are to file as Head of Household (get more tax credit) or Married filing separate (way less tax credit). if I file Head of Household could this cause a red flag when is time to summit the Affidavid of support?

I dont believe so. I dont think it affects you until your spouse is physically in the United States. To be 100% sure consult with your accountant or who ever files your taxes. 🙂

I am same situation, I am going to file jointly and in spouse ssn field just put NRA (nonresident alien) and make a letter both will sign saying you both want to be treated as us citizens for tax purposes, but you may have to claim their income if any. And will have to mail taxes in can’t e-file..

Correct. Consult your tax professional, however when I filed for my taxes, I filed head of household, because my spouse is still overseas. We will file joint once they come to the US. You cannot file joint if they don’t have ssn
