Filing I-485 after 10 month of I-130
Hi all, I applied for I-130 for my husband in last august 2022, and it’s still pending. Now my husband came to USA on b1/b2 visa last week, can I apply for I-485, I-765 , I-131 now? or should I wait 90 days? please help me.

@Nahid Sabrina you can apply for his I-485, I-765and I-131 after 90 days .. but make sure to update the Uscis that you will continue the process from here to avoid sending your approved I-130 to the nvc .. you can call them and request this update or you can write a letter to the service center where the I-130 processing now along with a new I-130 or at least the page of the application asking if you want the process inside the U.S.A or at the Embassy

@roro April 2022 thank you. I talked with live agent of USCIS. She didn’t mention about 90 days, she told me that I can apply for I-485 right away

@Nahid Sabrina I and my wife did the same thing. she is a USC filled i-130 for me last year in june. then i came to US on b1/b2 to attend a wedding of her cousin. And while i was here we decided to file for i-485 after 90 days. still waiting for the approval though. we wrote a cover letter explaining the situation. Also my wife became a citizen in november last year after i came to US, so we also called the USCIS to make change on the petition adding USC is filing not permanent resident. we uploaded here naturalization certificate to i-130 and also we added it as a proof with i-485 as well. hope this helps. feel free to ask anything! hope you get through this smoothly!
