CR1 is faster because there is always a visa available for this type of green card, and therefore does not take long to get interview and green card done. F21 takes twice, and sometimes even three or four times longer than CR1, because you have to wait until a visa is available for your category.

omg why is that?

is green card holder fast or us citizen

because CR1 are an immediate relative of a US Citizens, while F21 is an immediate relative of a Permanent Resident. USCIS will always favor the relative of a US Citizen. There are no caps on CR1 visas, while F21 has caps. If your husband/wife is still a green card holder, it would be better if you applied as soon as possible. If he is about to become a citizen and has already started the process and just needs to do the oath, then it would be wiser to wait for now and then apply through CR1. Good Luck to all spouses of green card holders…

You’re still at the beginning of the case. it probably changed because your partner was not a us citizen.

is your husband a us citizen?
M
Matheus SantosJan 1, 2022
if he is not, you cannot change it unless if he becomes a citizen. If he is not a us citizen, then it was probably a mistake on the USCIS part

no he is not a US citizen. but I am actually confused
M

then it won’t change to CR1. CR1 is the category for spouses of a US Citizen, therefore unfortunately you do not apply in this category.

Find a lawyer (if you don’t have one) and talk to them about your case

USCIS give preference to citizens that green card holder. Green card holders are just documented immigration following the legal path of living in the state. CR1 are immediate relatives of a US citizen. USCIS will show favor to a citizen than a permanent resident. On the other hand, the entire process is luck, paying keen attention to detail and filling out the forms and pay the fees in a timely manner. I believe the playing field is level and everything depends on luck.
