F1 income for affidavit support
Hello All,
I am filing for my green card through marriage. my wife is a US permanent resident and I am on F1 visa.
My wife doesn't work so she has no income and doesn't have assets. The lawyer told me that I need to find a joint sponsor with her to demonstrate that I won’t become a public charge and rely on the government. I have income from CPT (summer internships) and F1 (PhD stipend) and assets (liquid savings) that are way above the government poverty guidelines.
However the lawyer told me that we cannot use my assets/income because I am the intending immigrant/beneficiary of this matter to obtain my green card. We can only use my wife's income, otherwise my case will be rejected and my wife cannot sponsor me as long as she doesn't have income.
Is that correct? Is there any workaround for my case?

I was also in same situation, F1 student applying though GC holder wife and due to her insufficient income had to find someone to joint sponsor. My ead got approved within 10 days of submitting all those and I believe thats the only way too.

get someone that makes over 50k to 100k to sponsor you. And your wife need a job to support you otherwise you might not get through. Also your lawyer is right and knows better there’s no need asking for public opinion lol just do the needful.

@user33 anyone can be your joint sponsor, just make sure to still fill out I864 for your wife and you could add your income under beneficiary’s income section as support and fill out another I864 from your joint sponsor who makes more than poverty guideline recommendations. hope this helps. good luck.

also I would recommend either writing a note on last page of application or a letter explaining your situation.
