Expiring H1B
Hello. I just need your insights regarding my current situation. So, my H1B visa is expiring this coming September 15,2024. I already reach my 6th year for that visa. My previous employer promised me that they will do the sponsorship for the permanent residency which is the greencard but because they turned over the ownership to other company, that messed up the process and put a halt of the processing. Now, the current employer did not say anything yet if they are still going to do the sponsorhip that leaves me hanging and my employment at risk. What advices can you give? Can I sue them for their neglegence?

I don't think I am eligible for those two. I am a medical technologist. So if the employer decided to pursue with sponsorship and start the process now for the green card, will I be able to stay pass the expiration date of my H1B visa? or I have to be deported out of the country and wait until the green card will be completed?

Honestly, you are almost out of time. Even if they start the process now, you will still be out of luck by your current expiration because wage determination&PERM application takes more than a year before they can file i140 for you. Your best best will be eb1/eb2 with premium processing. This way, you can extend your h1b status. Email me at fregnita@gmail.com
