Expired EAD
My EAD is expired and I sent in for a renewal before it expired and have the receipt notice that automatically extends it for 180days, I got a new job offer and wanted to know if anyone has been able to used the expired EAD and receipt for I9 verification?

I am in the same boat. I haven’t submitted my I9 to my employer yet. i think it varies depending on the employer. but I think it might get problem so I expedited it. still waiting for the expedition result

you can use it, yes, but you will have to show an actual EAD card on the first day of employment. most employers would not take an expired one despite the extension and would require the new EAD instead. but for the hiring process and all, the EAD and the extension are good. if the new employer's process is long enough for you to get the new card in hands, then it's no problem. if not, then you'll have to convince them that you're eligible to work legally and that your extension is going to be approved. 🤞

minyu - a lawyer can, but whether it's you or alawyer it's up to the employer to believe or not. I've been in a similar situation, but my luck was in the fact that the employer's hiring process takes months and I had applied for my EAD renewal a few months back too. so, I obtained my new EAD during the hiring process. during the hiring process, and depending on the documents that your employer requires, your driver's licence can be enough provided it is enhanced (Washington state) or a REAL ID (every other state. Real ID is recognized by a yellow star on the upper right corner). showing employment eligibility with the expired EAD and the I-797 extension helps but those are accepted when you're already with the employer, rarely before. so, there are chances that they might not accept that. and if they do, you will definitely need to produce the new EAD on day 1 of employment, or at least an I-797 Approval if you don't have the card yet, with documents like your passport, and or social security card.

@Lilo that’s what I am thinking, some of these employers don’t know anything about the immigration system and may outrightly refuse. it’s a new job but remote so I will even have to verify employment status at a ups or notary and these pple tend to be ignorant too. The next hurdle is even if they agree technically it’s only for 6months so which employer wants to finish wasting money training you if in 6 months you might have to stop working 🤦🏽‍♀️🤦🏽‍♀️

JB - you're so right. I wish all employers would get mandatory immigration training. they discriminate a lot of us for employment based on the EAD even when they're current. and that's illegal. but who's going to sue them? so they keep doing it. 🤷‍♀️ about the I-797 extension, that's why I said it's easier when you're already with the employer than when you're not. if your EAD expires while you're waiting for the new one, with the extension you can continue employment, and it is against the law for an employer to fire an employee over them working their paperwork with immigration. you do have to stop working until you're eligible to work again, per the law. but for new employers, since you're not with them yet, you need to provide the actual unexpired EAD card. some companies (very few) are more knowledgeable about the immigration laws than others, and they would even assist you in the process. most ignorant ones will blatantly say no. 👀
