Expediting EAD and 485
Hi all, I recently lost my job but have a new offer ready. I have an approved I-140 under EB1A, and my priority date is current. Instead of transferring my H-1B, I’d prefer to start working once my GC EAD is approved, so I don’t have to deal with H-1B transfer risks and delays. Has anyone successfully expedited their EAD in a similar situation or any other reason where you had to expedite the process and were successful? Any tips would be appreciated — trying to plan my next steps smartly. Thanks!

if you have a new offer ready, I think it might be worth a try putting the expedite request. They might ask for offer letter as evidence and then approve your request and ead. Clearly, you will have “severe financial loss” in the amount of job offer + savings depleting for monthly expenses if GC EAD is not approved. I think you have a good chance. this is not legal advice. You can consult your attorney as well.

i think there is premium processing option for I-765 (EAD). https://www.uscis.gov/forms/all-forms/how-do-i-request-premium-processing

See this statement in the link above What is it? Premium processing provides expedited processing for the following forms: Form I-129, Petition for a Nonimmigrant Worker; Form I-140, Immigrant Petition for Alien Worker; Form I-765, Application for Employment Authorization; and Form I-539, Application to Extend/Change Nonimmigrant Status.

Thanks @amdsk a for the response. My 485 is in filing stage, Im hoping it will be filed in two weeks, awaiting my medical report. I wanna make sure if there is any way to expedite so I can include that before I submit.

i think my employer did that for me. I had my EAD in less than a month but it took about 3 months for them to approve my dependent EAD. in fact when I checked my I-765 receipt, my employer paid over $3000 for mine while my dependent was around $250. that made me think it was premium processing

@Eric . No PP for GC EAD, I believe it’s applicable only for OPT EADs

@S J Got it. You can only put an expedite request once they receive the forms and you have receipt numbers. Sometimes, even biometrics have to be completed before you can request expedite. I485 and related forms receipt numbers sometimes take time to be generated unlike other forms. So you may get receipt numbers in mail between 1-6 weeks after mailing your forms.
