Jada - it just means they've assigned your request to an officer to decide whether to expedite your case or not. from there only 3 options exist: 1. they believe your request and accept to expedite on the spot, or 2. they want to see proofs of your claims as to why you want your case expedited, or 3. they denied the request to expedite. in 1, if they accept to expedite, you'll get an approval on your case very soon (provided you have sent everything for the case itself) in 2, they may accept or deny after they have received the requested documents.

Is it advisable to send documents now, without NVC asking for them?
Lilo PelekaiDec 3, 2021
Jada - no. you need to wait for them to request them as they will also send instructions on where to send those documents. 🙂

Kimmy - Deny what? please, specify.

why did you withdraw the i130?
j
jada dJan 30, 2022
so someone would have had to submit to have the i130 petition withdrawn
j
jada dJan 30, 2022
I would definitely call about that. Email, what does it say on your account with Uscis website?
j
jada dJan 30, 2022
In order to have a withdrawal, someone would have had to submit a withdrawal to the uscis?
j
jada dJan 30, 2022
A withdrawal means the petition i130 is canceled.
j
jada dJan 30, 2022
I would call them
j

A withdrawal means the petition is canceled. I know of 1 case personally where the girl withdrew the i130 petition for her husband because she was divorcing the husband. so the withdrawal means its canceled not going to go through. I would definitely find out what is going on.

the i130 is the petition you would have filed for your relative, NVC is where it sits waiting for interview, but it all is from the original petition I130. without the i130 petition your case would not have gone to the NVC.
j
jada dJan 30, 2022
From my understanding withdrawal for I130 will effect the NVC case because it is the same case.
Lilo PelekaiJan 30, 2022
thank you, Jada. yes, Kimmy, call them. dial the 800 number and say, "infopass" to get to a live agent.

Usually the sponsor withdrawals the I130 petition and when that happens the immigrant will not be allowed here. The process will have to start over with another sponsor and i130 being filed. Are you the sponsor?
j
jada dJan 30, 2022
The I485 would be denied because the i130 was withdrawn.
j
jada dJan 30, 2022
I have read where if you dont keep in contact with NVC for 1 year the case would be canceled. Maybe thats what happened.
j
jada dJan 30, 2022
That's horrible they do this to people. I would get a lawyer and sue the government.
j
jada dJan 30, 2022
my husband been waiting at NVC almost 3 years
j
jada dJan 30, 2022
I am going to get a lawyer and sue. The lawyer files a Writ of Mandamus. That forces the government to act on your case.
