Evidence showing My mariage is real after legal separation for petition to remove condition on green card
I received a letter from USCIS asking for evidence showing that my marriage is real.
Initially I went to the interview without my formal wife cause we are now separated and she is living in another state. The interview didn't go as expected cause of my formal wife not showing up. I received a letter today from USCIS stating that I have 30 days to mail them evidence that our marriage is genuine. I'm actually in the process of getting a divorce. I have all paper about everything we shared together while we were together such as insurance (car, health, dental, life, home), lease contracts, joint bank accounts, bills even initial letters from friends and family. I'd like to know what strong evidence and extra evidence do I need to provide?
Thank you.

submit everything you have when you were together.

just send everything again plus the tine after submitting the I751 form. The problem that was because you didn’t convert your process into divorce waiver.

@God Bless I’m sorry to be tough on you but you just took something that would’ve been very straightforward and messed it up. You had no business showing up to an interview for a jointly filed I-751 knowing fully well your marriage is in limbo and your spouse won’t be there. You should’ve either withdrawn that case or written to them to inform them of your legal separation and intent to file for divorce and request that your case be treated as a waiver. Showing up to that interview was a terrible decision and if you do not response with clear and convincing evidence, this case will be denied and you will get put in removal.

@God Bless For us to help you, you need to let us know what evidence you sent in already. That way we aren’t saying stuff you already sent.

@Rocco Forté the person doesn’t even need to tell us what evidences he had submitted. And no, he will not be put it in removal proceedings right after a denial, if that happens. he needs to consult at least with a paralegal and they will help him to do the right thing. I know many people who sent everything they had since the beginning of the marriage, and this worked out well.

@Verah Ans Lol ok

@Rocco Forté because you don’t even know if the officer will consider his evidences as clear and convincing, and already said that the case will be denied and him putting in removal proceedings. this is a very accurate decision for some random person. he has ways to fix it and he will. I am sure! also, he did a good thing showing up without her and tell them know the truth. the right thing though was that he needed to convert it into a divorce waiver before the interview being scheduled. if that happened, again he did good by going and letting them the truth. Since immigration jurisdiction allows residents/non resident and citizens to apply for many forms without lawyers assistance. it’s completely understandable that people can make mistake. if the intention of the interviewer would be a denial, he/she would do that without even give him time to send more evidence.

@God Bless Ask your wife to write a letter about your marriage and why it comes to an end. letters from family and close friends. you also write letter to convert jointly process for divorce waiver and why it ends. think about every single thing you guys had together. pets, veterinary bills, cards, trips… They will ask for the divorce decree. if your marriage was real you will be fine! good luck! there’s a lawyer on social mídia Brad Bern stein. they can advice you.

@Verah Ans I will take it that you are oblivious to who the current president is, because if you aren’t you might opine differently on this matter. One of the main things that puts people on the immigration fraud list is showing up to an interview on a jointly filed case without their spouse. I don’t need to convince you of this because as you can see, @God bless has been asked to prove his marriage, even with all the evidence he submitted. I went through the divorce waiver process so I probably know what I am talking about. Not trying to do a back and forth you so this will be my final response to you lol

@God Bless The reason you are here asking is because you have exhausted all the evidence you can possibly have…and you are now separated so no way of generating evidence. You need to amend that case to a waiver with urgency,m. Do not listen to people tell you to be cute or casual with a case that you have received a NOID on.
