@t Swhhss it may mean whatever you had before the judge either trying to adjust, trying to terminate whatever you had requested has been granted. the appeal part is just to give ICE (prosecutor) the chance to appeal the judge’s decision, before the judges decision is final. most times ICE doesn’t appeal so whatever your request was you are good to go.

how do you check if your are in removal proceedings.

@tash 🥹 you need to be notified and get a notice to appear (nta), I presume.

@t Swhhss my husband withdraw i130 and the i485 was denied. I don’t know what is going to happen next.

@tash 🥹 it doesn’t necessarily mean you’re in removal. USCIS may issue you a letter saying your case got denied because of that and asking you to leave in so many days. but it doesn’t put you automatically in removal.

@t Swhhss thanks they issued the denial notice online, but It didn’t say to leave in 33 days. it’s just saying that I can file an appeal.

@t Swhhss your lawyer should receive the actual paperwork with the judges signature, then you can refile your i-485 and attach that termination letter in order to allow you to get your greencard.

yes the appeal date is to see if there is any opposition from Govt lawyer but in most cases they have no oppositions. once this has passed, they will notify USCIS of decision and proceed to work on your GC. my lawyer said I should wait 90days before I will receive card but it says 45 days online.
