Hi guys, My wife a USC, and we are living abroad, she filed I-130 for me and now it’s with the NVC (2 days back we submitted all the required documents) My wife is a pregnant, the baby won’t be eligible for the US passport through the Embassy, she has to give birth in the US, otherwise he will be as same as my nationality (Iraqi) I cannot let her go alone (she has no one there) and on the other hand I have no idea how long the process will take, she has to be in the US on April maximum Do you have any idea if I can get a visit visa and be with her ?

If she is a USC is there a particular reason why she can’t proceed with the CRBA?

@danny, yes but this mean we have to file i-130 for him and do the process of immigration for him as well

You will probably be denied entry on visit visa because you already have I-130 pending. She can apply for CBRA for the child. To be eligible for CBRA she have to lived in the US for 5 years in her life and some of those years have to be after the age of 14 ( I think). That is best route if you want to take that. otherwise, you can let her come to the US and give birth which I know is hard

@Sam, Thanks for you comment, She didn’t live for 5 years in the US so the baby won’t be eligible for CBRA 😢
