Emergency Advance Parole
has anyone travelled outside US and came back with Emergency Advance Parole while in removal proceedings. Pending AOS in court. I -130 is approved. please share your experience. thank you!

travel by...plane? i guess you might have a problem at the check in counter abroad before flying back. The airline could deny you boarding without a valid visa

then why would ICE issue Advance Parole document ?

USCIS issues advance parole so you can get past border inspection once you land here. But airlines have the power to deny you boarding if they don’t know that the advance parole is a valid travel doc. Airlines are required to make sure that all passengers traveling to the US have valid travel docs

ICE/CBP/USCIS knows what an advance parole is...but not the airlines. Some airlines know it, some don’t

but generally it’s not a self deportation if you leave the country with advance parole, because of the removal proceedings? or is it ?

I have a very serious reason to visit my mother who has stage 4 cancer, but at the same time I have a US citizen husband and Mortgage and I want to make sure this legal document is a way to come back to US

@Chtistine call the airline you’re planning to travel on and speak to someone there. Also speak with ICE as well. so you know exactly what to do.

@sorrynot sosorry, thank you, she is getting treated in my home country, the embassy is it even issung visas to US right now due to Covid. I have an appointment with ICE on 5/18 hopefully it goes well.

you can call the US embassy/consulate but afaik they are still issuing visas. Also, your mom doesn’t need a visa if she is a citizen of Euro Schengen countries (she can use ESTA) but she needs to spend 14 days outside of the schengen area before flying here

she’s getting treated in my home country at the moment. our family doesn’t have the money to bring her here for treatment. my concern is not about her flying here, but me coming back to the US

i think you need to call the airline before you fly to another country. make sure that they know what an advance parole is. you need to double check everything with your attorney too

also, there is a loophole for your mom to use medicaid in here so she can get treatment for free but that is another story
