Any chance the EB-1 Final action date advance in FY 2025?

Will have to watch two events - the family spillover from previous fiscal year to get finalized by DHS in Dec (likely 7k or more) and more recent 485 inventory data report from USCIS about pending petitions which could tell how many porting happened for India and also ROW given that eb2 is backlogged for all.

@huber Manu @a k , after doing some USCIS data sleuthing on pending I-485s from Sept 2024, it looks like there is ton of applications as of April 2022. I believe this process of I-485 approval is going to take more time than usual even after the final action date becomes current of our respective PDs. Let's brace for impact and wait patiently if some miracle happens to get our GCs before Oct 2025.

what is the dhs report? because ı am waiting for result for I-485 since 21 June 2024 (Eb1-a). my ı765-131 was approved and ı have combo card. ı am going to the my country but besides that ı am nervous. because ı have not taken my green card yet. ı dont understand why is the system slow? @a k (ı am row)

@Alice A. Usually around this time of the year, DHS publishes a report that tells how many visas (likely family based) they issued in consulates last fiscal year. If the overall number is less than what was planned for that year, the spillover trickles into EB1 quota during this fiscal year. over the past years, there were large spillovers that India EB1 was benefiting and that appears no longer the case since date is not moving. that said, none of this will matter to you. you are EB1 ROW and date is current, you should have visa number available but USCIS incompetence is what is delaying yours.

@a k thanks again for the pending I-485s inventory released earlier this month. Looks like not grear change from September 2024 report. Looks like approx 10K Indians waiting for visa till December 2022. Any thoughts when will we get into the availability status?

@V S Honestly I doubt if there will be any significant movements (and I am praying for no further regression for India). The ROW EB1 demand is consistently high now (both approved i140 and pending 485) and that coupled with Indian porters with early PD will keep this fiscal year busy. Note that based on predictions there will likely be a spillover of 5k family visas but that will be eaten away by existing people on line. From next fiscal year onwards this spillover will also NOT bring relief and once ROW hits the maximum due to increased demand then India will be subject to country cap 7% which will make things move in snail pace —- with a steady state being each year an early porter from India (below 2018) will grab the visa new availability. Sorry for pessimistic views but the reality is Backlogged ROW EB2 NIW are now entering EB1 (all they need is 15 day premium processing attempts) and family spillover into employment is coming to an end. we need both these patterns to shift (unlikely until COVID occurs again).

@a k thanks for your honest opinion. In a year 40K EB1s greencards are approved. Do you think it is still a remote chance we get our greencards before oct 2025?

@V S The only best case chance is final action moving closer to date of filing — which is April 22 (btw that is how USCIS works based on Charlie O commentary during his term as chief) On average, the ROW 485 filing rate trend is 1300/month and Indian porting rate is 150/month. this rate is in addition to what’s counted in the inventory already. so the magic relief for this year to watch for is family spillover. and of course Trump influence on this could break the trend (like L1A will get crazy hard for consultancies and denials for EB1A will be very common). On the other hand, the processing time for people in the 485 queue will go 2 year plus with all mandatory interviews like it was done in first term
