Brethren, I reached out to the USCIS last week about my case since it has taken longer than expected. Early this week my SR was assigned to an officer for response but it has been some days without any response. My PD is August 31,2022. Though my country is current, I’m surprised today when I called the live agent told me that my category retrogressed so they cannot approve it because they do not have a visa yet. But people with their PDs in October 2022 are being approved😀. I could not understand her explanation at all. Any idea or experience of what she said? Thanks

don't trust everything you get from live agents. they're just customer service representatives not actual officers.

that's worrying if no visas are available. I think they do Oct first to enhance their approval rate for fiscal year 2024 😏, everything before that for them is a backlog.
question to OP how do you know your case outside normal processing, I have same PD but their system didnt allow me to enter SR saying case within normal processing timeline?

It’s weird. I called again as I wanted to know my PD in their system. Unfortunately, the representative could not even get it. The only thing he could was the filing date of my form 485. Anyways, God’s time is the best time.

I was told that at NBC, form 485 is 12.5months. After that is when you can start following up.
