hy. my case under process since 2017 i didn't receive any mail or later from immigration or court house. anybody suggested me what can i do? i apply i140

hey congrats! I sent my I-140 in July and I’m waiting 2 more months to send the forms for the combo card! did get the approval for the combo card before??? Did you have to go to interview??

the combo cards are based on the submission of form I-485 adjustment of status. You don’t need to have I-140 approved to submit the combo card forms. There is no interview for EAD, only biometrics. The interview is for AOS in some cases. Why are you waiting 2 months to submit? did you submit I-485 already?

Im waiting because some friends told me that it’s better to wait a couple months to send the I-485! I’m gonna try to send the forms until December.

if your priority date is current I wouldn’t wait at all to submit I-485 along with EAD and Travel document forms, unless you have an non-immigrant status currently active and not close to expire. The Wait time for combo card is about 10 months currently. But that’s just my opinion.

it depends what type of visa you’re applying for. for AOS allocations it’s 10+ months

under what grounds can you ask USCIS to expedite an EAD. only “extreme hardship” I believe. that would not typically apply to a masters graduate applying for NIW. we are typically not in poverty. only refugees / asylum seekers.

you CAN expedite your EAD if you are NIW, because your EAD is based on AOS not the I-140. I did it and it was approved. However, you have to demonstrate hardship not only for you but for the company you work or will work for.

Thanks C A, I concur, you can have a Masters degree but you can’t survive 10 months without a job, that is extreme hardship

it depends what status you are adjusting from. USCIS isn’t forcing you to stay in the USA. in fact, US immigration law WANTS you to leave. if the wait for an EAD is too long, you’re welcome to leave the United States

Through a letter from my employer. I had an H1B that expired. Important thing here is to demonstrate this hardship more for the company than for your own financial loss. Anyways, Eumelio if your lawyer is telling that you CAN expedite, go for it. Remember, this forum is to share experienced not to give you definite advice. If you leave the U.S. your I-485 will be considered abandoned, which is something you don’t want to do.

I think yours was able to be expedited because of your unexpired H1B. that isn’t the case for most people. it’s not for me. and of course, you don’t WANT to leave the USA and abandon your AOS and go through consular processing. but no one is forcing you to stay. USCIS doesn’t care about your inconvenience.
