(ROW, from 75 country IVP pause, but not from 39 visa ban countries) (J status was subject to 212 e but received a "Not Subject Waiver/Advisory opinion) I140 PD: Apr 26, 2024 (NSC) Concurrent Filling (I-485/I-765): Jan 27, 2026 (NBC) Biometrics: Feb 18 → Multiple FTA0 updates EAD: Feb 23 (Primary at NSC, Derivative at NBC) → Only silent update (never approved) I-140 PP Upgrade: Feb 23 → Approved in ~4 days → Same day: I-485 first silent update Then: Mar 19 → Silent update (Derrivative moved to Chicago FO) Mar 25 → Silent update (Primary and Derivative moved to LA County FO) Apr 1 → Silent update (Morning) Apr 1 → 3rd FTA0 (Afternoon) Apr 4 → Silent updates (Saturday) Apr 5 → ✅ Approved (Sunday) Apr 9 → Card produced Apr 13 → Card delivered This community really helped understand Multiple routes the cases take and possible timelines!

@Green Card 2025 🙏🏾 yes, that's exactly what Concurrent Filling means. My DOF was current on Jan 2026 Visa bulletin that allowed me to file i485 before a decision was made on i140. My FAD became current in March 2026 Visa Bulletin, about a month after I applied for i485. Since April 2026 visa Bulletin, both EB1 and EB2 are FAD current that means anyone can submit both i140 and i485 together. This saves them from future retrogression plus they may get EAD/AP until the i140/i485 is approved.

I have the same dates just some days of differences. Do you recommend to apply to Premium Process? My lawyer told me, just wait the regular process but we're waiting for more than 2 years! And there are people applying and winning their process whit premium. Don't matter if they're receiving one RFE. I'm frustrated... I listen your advice...

@Andres Escobar 100% go for Premium. I waited for 22 months before Upgrading because my Law firm was recommending to wait it out. There indeed was a wave of unreliable rfe in late 2025, but even for people that got rfe now have their case approved. It seems uscis is clearly prioritizing pp. Use trackmyi140 . com and you'll see how batches over 24 months are still pending but batches <2 months old have approval in thousands that can only be due to PP. Lawyers prespective in my opinion in this situation is to avoid additional paper work due to unwanted RFE and risk. As EB1/EB2 are current, it makes sense to upgrade and get to i485 stage than to wait it out.

Hi! Congratulations on your approval!! I'm on EB2 NIW I got my i140 approved in April 13 using PP. I'm working on filing the i485 and I plan to do it myself. Could you please share your experience on the i485. What documents to prepare in addition to birth certificate, i94, IDs, i140 approval, i693. And what resources you think can help. I'm currently a PhD student in the STEM field working as an RA and I'm on F1 visa. I have two derivative applicants on F2 visa. I would greatly appreciate your help.

@T K I had originally planned to request Premium Processing in October 2025. However, they informed me that they would not assume responsibility for any potential Request for Evidence (RFE). Consequently, I decided to file for Adjustment of Status (AOS) in December 2025, as I did not want to risk falling back due to a Visa Bulletin retrogression. I reached out in February 2026, and my paralegal advised me to simply wait for the regular processing track. Yet, upon analyzing the data on trackmyi140.com, it is clearly evident that there are applicants from as far back as 2023 whose cases appear to have been completely overlooked... The critical issue now is that my student status is set to expire in just two months.

@Andres Escobar I do understand. yes, if it's in your contract, it's best to wait because your law firm will not help if it's not in contract. luckily for me, my contract allowed me to do it. try to push them maybe and ask for a change in your contract?

@A. J given that you have derivative, don't forget your Marriage certificate, their i20s, employment letter (as an RA) personal statement, a cover letter, 3 pay stubs, all us visa pages, eads if any.
