EB1-C I-140
I applied for premium processing I-140 in September of 2023. within a couple of weeks, I received an RFE asking for things that I had already submitted. it was a pretty long RFE asking for everything under each category of eligibility. my lawyer said this happens at times when the adjudicator is just trying to finish the week off and buy some time before he/she has to review the application. 27 days ago, we submitted the response to the RFE with even more evidence. I would assume my reply was at least 300-400 pages, if not more, of evidence. for the past 27 days, no movement. I know they have 45 days to make a decision, but I keep seeing posts of people getting their decision within a week of providing an RFE response. has anyone else heard this from their lawyers? And has anyone else experienced this kind of delay to the last few days of adjudication? background: EB1C - ROW filing only I-140 and will file I-485 after filing as functional manager.

if you paid premium processing you should already had a response. I got an RFE on eb1a just like that. got an approval in 7 days. uscis has 15 days to aprove, deny, rfe, noid. and those 15 days reset after you get receipt notice update. that’s it if you paid premium processing (thinking you mean that by priority processing) , so if you used premium processing you should do an inquire.

yes, I meant premium processing. for EB1-C, the premium processing is 45 days (it is 15 days for EB1A and EB1B).

oh, then they still have time. my rfe came at exactly 15 days. so, in your case they still have 18 days to answer, if your lawyer did a good rfe reply, your rfe was boilerplate, and you fullfill your category criteria don’t worry. just wait a bit.

I saw recently that USCIS was no longer counting weekends and holidays only working days. sending good vibes so you can get yours soon 🙏🏼 I had premium process as well and they denied me even after RFE. My lawyer and I decided to take the longer route so the adjudicator had enough time to go through my 500 pages without making a negative decision. It took 5 months but it came back positive! I am now waiting for an RFE for my medicals since I had decided to send my i485 back at the Same time I had sent my i140.. Just did medicals last week so my lawyers can send them in as soon as we get that RFE

thanks @J Marques . Are you also EB1-C? I can’t think that any adjudicator will read 100-600 pages. from what I read, they spend 20-30 mins per application. so they probably sample the evidence and make a decision. As the COO of my organization, I would hope that signing of agreements and hiring personnel (among other things) would show that I meet the thresholds for approval.

I’m sure you’ll be just fine. As per the convo I had with my lawyers they said that once they stop a case to get more evidence, they are consequently pushed to read it more throughly. I am an athlete under EB1 only! Best of luck 🫡🙏🏼
