thank you. it was out of normal processing times by around 2 months. I tried to leverage them few months ago as well but the congressman had said the case was still in normal processing times at that time. so I suggest reaching out to them if your case is outside of normal processing time already

Confrats! I have a PD of February 2020 TSC, I140 approved in Sept 2020, no medical RFE yet either. I will SR once more (waiting on response from 2.12) and then enlist Ombudsman or Confressman.

I am happy that you got approved, but I am also confused. Why would a EB-1 sub cat. 3 candidate wait almost 2 years to be approved? Thats not good, those cases are normally prioritized. Wow, happy your wait is over, congratulations.

I am the same Mark, EB1-3 filed Feb 2020, I140 approved Sept 2020 and the crickets…….first EAD came in 3 months, which has now expired! I can’t travel.

writ of mandamus basically means you’re suing USCIS for failing to do their job, and abusing their position. it’s a tricky one that has to be discussed with lawyers but it’s the last resort you have to solve situations where it’s clear they didn’t do their job on time and delayed endlessly without justification. it works mostly if there are large delays of a couple of years from the last action

@M G: same date as CG 7! then why this huge delay in moving I-485? my I-140 was approved in October 2021, I hope it won’t take one year until I get the RFE for I-485... Any views if there is any influence from I-140 approval date on movement with I-485?

Mihai, tbh that period was the most silent period in our case. it took 11 months to get RFE for medicals after i-140 approval. There was zero communication in between. but it was covid heavy time, government changes etc. so hopefully it’s faster these days

yes P C, my I-140 is approved but it took me A LOT of time. from August 2020 to October 2021. I can’t wait one more year for I-485. I’ll be outside of processing period for I-485 on March 14th, looking forward to call USCIS and talk to them

My i140 got approved on April 2021 but am still waiting on i485 approval. I’ve been out of processing time for about 3 months. I reached out to local congressman and they sent a letter to USCIS on my behalf on Jan 4. I’m crossing my fingers something updates soon on the website 🤞

I believe I am EB3 and yes I raised SR as soon as I was out of processing time and I received a copy/paste answer saying they were still working o n other cases and that I was in line…

@Mihai No news yet. I submitted a 2nd service request last week since I’ve been out of processing time for 3 months, but I feel SR don’t really do anything. They just tell u that ur case is still in line to be adjudicated. I am also hoping to hear something from congressman soon since they sent a letter to USCIS about 3-4 weeks ago…

my biggest hope is that the trend of transfers to other centers continues. I did some calculations over the weekend and I saw that Texas service center slowed down the pace even more in the last 4 months. in the last 3 months of their previous financial year (so July to September 2022), they approved 6k cases. in the 4 months from October to Jan, only 4.5k cases! that means all cases currently pending in SRC would be processed in 8.5 years!!

they didn’t manage to reach 100 cases approved in one day since December 1st. on average they process 40-45 cases per day. that’s a pathetic average, it will take them 10 months to finalize even FY20 cases. but in October 2020 they had a HUGE inflow of cases so I’m curious how they plan to address that

did you try to speak with an agent? once I’m outside of processing time I’m planning to do that. I’ll tell the agent to send me the medical RFE, hope I find a reasonable person to listen to my plight. agree, SRs don’t solve much

I haven’t called USCIS so far but I understand there’s a way to get an agent on the phone. you call the number on USCIS site and after a while (be ready to wait up to one hour from what I’ve read), you talk to an agent. apparently the word to get to an agent is “infopass”, but again I haven’t called yet so I’m just saying what I read on other groups

I tried speaking with an agent once by using Emma (the chat on USCIS website) but they wouldn’t give me any info on my case because it was filed through my attorney so they could only give her the info… which I thought was nonsense. But I guess I have nothing to loose by giving it another shot.

my attorney is offering a service to call USCIS on my behalf. of course, it’s not free and they are charging me $250 per call. I’m seriously contemplating paying them to call. even there’s even 10% chance they get something more than me, then it’s a good investment

Hi Mihai - the agent should be able to give info to both the applicant and the attorney who filed the application - so they are talking rubbish. The Emma agents are call centre staff essentially that only have access to the same information we can see, so a waste of time really. The congressman I contacted will only get involved once it goes past the processing times at the FO which I have another 3 months to wait, however, USCIS need to respond to you based on where your case is at the time - for me / you it will be TSC, until it moves to local FO.

agree CG 7, it’s a bad process. my field office is 4 months later than Texas Service Center so probably my case will take 4 more months. but I’ll raise SR once I get to the TSC date

I am within TSC date (July 2020) and I am February 2020, however, I will get moved to the Houston local field office which is later - it won’t move to Houston, until they process my medicals which they have it asked for yet.

Honestly, no idea. it won’t be later than July, one of my colleagues got theirs last week - they applied a month after me. It’s a lottery.

I also have colleagues who applied two months after me and got their green card in August last year. it depends on concurrent vs non-concurrent filing, on their respective field office, on the adjudication officer etc. But you’re right, even for absolutely similar applications it’s still very significant differences. I hope we’re all going to get the green cards soon.

This was the response to my second service request. Again, another vague answer: The status of this service request is: Based on your inquiry, we have reviewed the status of your case and found that it remains under active examination. This office acknowledges the completion of your case being outside of the normal processing time and realizes the inconvenience it may cause. The delay has been necessary in order to ensure thorough processing of your case. Unfortunately, we are unable to provide you with a definitive timeframe at this point. USCIS will notify you if any further information is needed from you or when a decision has been made. We hope this information is helpful to you.

this is showing how many I-485 LB cases are in total pending with SRC for FY20, and how many are in each stage: for 15k fingerprints were taken, 7k were transferred to another office, 5k rejected, 3k RFEs etc. For me it’s important how many were pending in each stage as this way I can assess in a better way when they will reach my case. if they maintain the RFE rhythm recorded in the first three week of this month, we can expect to go through the majority of the open cases and send RFEs in the next 2-3 months.

Not Ombudsman yet, tried congressman and they won't help until I am outside local processing time of the FO, which is Houston and 28 months - even though TSC is 20 months. Also, that EB is not even going to local field office!

That’s crazy. My congressman sent a letter on my behalf about a month ago in regards to status updates and we haven’t heard back. And I’ve been trying to submit ombudsman forms for the past 3 days but the server keeps giving me an error. I think they might be doing maintenance on the website… Tried calling them today and was on hold for more than an hour so I had to hang up…

@L S: long time :) to your point, unfortunately ombudsman is not helping anymore with individual cases that are outside processing time. You’re both in February so you should really see some traction in the next period, as I see a lot of action either on transfers or approvals or RFEs in Texas. I am 6 months after you but I am hoping I will get some action soon. I went last week to do medicals proactively hoping it will speed up the proces (I didn’t get RFE yet but I will send them even without RFE)

The next thing I am planning to do is file a FOIA request. Someone in another post explained how that worked for them. I need to research that option because I am not sure what that is but at this point I am trying everything that’s working for other people.

I’ve heard about that. Freedom of Information Act, that’s FOIA. not sure I understand yet how is that going to help. I read somewhere that it can help you get a copy of your approved I-140 in case you plan to change companies using AC-21 but not sure how it can he’ll otherwise. I need to research more

Go to the community section of this app and search for “FOIA request” … the post was done 4 days ago by someone with a yellow profile picture. I believe the title of the post is “N400” and the first sentence of the post says “This is very informative.” I wish I could link it here so you can read it. He explained why all of us that filed during the first months of covid are in limbo and how a FOIA request helped him.

FOIA request will show you the content of your file, including USCIS notes, and this might trigger a faster resolution especially for cases that are so much outside processing time like yours. let us know how it works!

I’m not in the position to give advice to anyone but if I were you, I would wait 3-4 more weeks as there is a very significant chance to get RFE for medicals. they are now issuing about 150-200 RFEs per day, so they will reach your series super fast

187... they issued 10 RFEs in that series last week, 5 on Thursday and 5 on Friday. not much considering there are approx 400-500 cases per each series. let’s see this week, I’ll keep you posted with how many RFEs are issues for this series if you don’t have access to data yourself

the Texas center is all over the place but surprisingly there seems to be some order for the RFEs. Your RFE should come in March hopefully. if it doesn’t, you can always interfile medicals separateky, it won’t hurt

@CG 7: you’re asking about my last 3 digits? for SRC LB cases, the last 3 digits indicate the position in the 1000-case series. for example your series, SRC2090187 has 1000 cases. Not all are for I-485, as there are I-140, I-765 and other types of applications. If you’re asking about the last 3 digits approved or transferred in your series, then unfortunately USCIS doesn’t process them exactly in order, so even if you would have cases transferred or approved just next to you case, it doesn’t mean they will approve your next. It’s still a good sign as it means there is action in your series, which in this case happens consistently for the last 3-4 weeks. Hope the consistency stays.

I haven't looked, but given I am in month 25 of a 19 month process - I'd be surprised if they moved me. I got my EAD yesterday, just waiting on the card and hopefully they have given me the combo.
