EAD Renewal - Pending GC
I applied for my GC and I-131 in May 2023, after one year of approved asylum, and now my EAD is expiring in May 2024. Should I renew? How long would it take? I don't want to get in trouble with my company, but I also don’t want to pay if I receive (hopefully) my GC soon. Help! Anyone with the same issue? Thank you!

I spoke to a lawyers assistant and she said asylees do not need to renew the work authorization if they changed their SSN status, and If they have the i94. I don't know if I believe that. but something to search about.

yes asylees do not need work permit make a info pass appointment in local field office they will give you i94 i did same

@Barbara Bauer Do NOT freak about it. You should update your job with a copy of your I-94, which shows your indefinite grant of asylum and your authorization to work. Those two functions are endorsed on your I-94. Your employer should update their file and allow you to work without any other additional verification. If available, please update them as well with your new unrestricted social security card you may have already obtained after your asylum grant. That is also another proof. Hope that helps.

@E Hopeful I didn't get a new social security card. Is that something I should request? I always thought the restrictions of the SSN get removed, but I keep the same number. thank you!

@Barbara Bauer You should go get a new social security number. The numbers are going to be the same, but they will ask for proof of legal status for them to update it on the backend. So you should take your I-94 (the stamped one) with you for that matter. The reason it is called unrestricted social security because they will remove the DHS lettering on it, which says only valid for work. Once done, the new one will only have your name and the numbers, but nothing else. You should also update it once you get your green card and US citizenship. Empoyers can tell you have legal status by just looking at your SSN or during E-verify in the event you don’t have anything else. While you are figuring out the day to go to social security office, please update your employer with your stamped I-94 as soon as possible to keep your employment with them. @E Hopeful Hi, I went right away to Social Security location last year after receiving granted asylum, however they never sent me a new and clear SSN 🤷‍♀️

@Barbara Bauer I am in the same situation my DL is also expiring but in February I am still waiting for my GC and I really don’t know what to do now 😂 I guess I will go to DMV with I-94 and try to renew my Driver License, I don’t know

@Cristina B you should go back to social security office and the DMV. Maybe you changed your address without letting them know. The social security office will always give you some paperwork memorializing their appointment with you, but will always tell you that you’ ll receive a new one in the mail within 14 days. So why you never went back or even call to inquire ? You have to be proactive otherwise nothing will happen.

@Cristina B The DMV will issue you an updated DL based on your status. The validity will be the same as that of permanent resident and US citizens, which I believe would be a 5-year one, depending on your state.

You can also present the judges letter, but the issue of jurisdiction is nonsensical on its face. And it should not be even invoked when applying for a DL. Jurisdiction applies when comparing IJ vs USCIS. A quick example, USCIS cannot terminate asylum granted by an immigrantion Judge (IJ), because USCIS does not have jurisdiction over IJ proceedings or orders. But USCIS can remove those granted by an immigration officers as they are issued via non adversarial proceedings.

@niko lumi sorry to hear that. You only met an incompetent representative who did not know what the hell he was talking about. Maybe a lazy rep who could not even do a quick research along the docs that are accepted. The funny thing is that the IJ (immigration Judge) stamp is marked on the I-94 when your asylum was indeed granted by an Immigration Judge (IJ). what a silly rep who gave you a bad experience !

you have to renew it, it’s not going to cost you anything because you’ve been granted for asylum the application is free.

No need to apply for it if you are already granted asylum. The first one is free when you are granted asylum, but after that you have to start paying for it. So why waste money if you are already have an I-94 which states you are authorized to work indefinitely and an unrestricted SSN ?
