EAD
hello, I applied for my vawa in August 2023 and last year march I applied for a work permit and it’s been one year and I haven’t received anything yet . I called USCIS shaking and they told me to call back in 2 weeks to open a ticket ? has anyone experienced this ? do I have to get the vawa approved in order to get an EAD? help pls

did you file c09 or c31?

I file VAWA only which was c31. I had to wait until my VAWA was approved to get my work permit. I waited 3 years.

check the category of EAD you filed for. if it’s C31 you will have to wait for your Vawa approval, so it’s best you fill out another I-765 for C09 attach it with your I-485 receipt and send it in.

they told me that if I apply with a C09 it would be an adjustment of status which it would basically mean approval of vawa they told me that it was just an I765 but I believe the people they have at the USCIS service line are incompetents because when I was asking for the type of EAD he couldn’t give me a clear answer of what I was talking about

if you file a c09 you'll get the ead while waiting for the approvals vawa and green card.

I spoke with a different lawyer and they told me that my lawyer had to file I765 along I485 and if they filed the wrong form I’ll stay waiting forever
