1. Spouse citizen - you can submit EAD i-765 and AP i-765 with AOS i-485 concurrently or anytime after filing Vawa i-360. NOTE it’s going to be c(9) category for the work permit. They will work on EAD/AP asap after the biometrics.
Spouse permanent resident - you can only apply for EAD c(31) category on your VAWA application and it will be approved when your petition i-360 is approved.
You need to wait for Vawa i-360 approval to file for adjustment AOS i-485 and EAD(c9) and AP.
Basically you can work and travel before Vawa approval only if your spouse was a citizen.
You can have both EAD c9 and c31 pending and approved at the same time. You can renew them individually until the AOS is pending. Before c9 used to come as combo EAD/AP valid for 2 years, and c31 is only work no travel and valid for one year. They say they might separate new EAD/AP applications filed together to ‘speed’ up EAD.

2. Risk of travel is depending on individual case. Best to consult a lawyer. In general - if no asylum or removal, clear police report, and entered legally (inspected) - you’re good to travel. There’s always risk because it is up to CBP to let you in but it is widely used. I’ve traveled after an overstay for over a decade! with no problem while my Vawa was pending.
3. AP is valid for multiple entries. No limit.
There’s an Emergency AP - valid only for one entry.

@Jully T. Bravo 👏🏾 but you must have had your C31 Vawa approved long time lol because the C31 card is valid for two years now not just a year lol

@Kenny Kenny thanks for pointing it out👍. To clarify:
Between 10 edits and no coffee🫣 I meant to say that, if they separate EAD/AP, the paper AP should be valid just for a year per USCIS website. Both plastic c31 and c9 EAD or combo EAD/AP cards are with 2 year validity since sometime in 2021 to ease up backlogs and spread renewals. The only good thing that came out of the pandemic🙄. Someone please let the fam here know if in reality it is different with the new ‘separated’ EAD/APs. I just got my 2-year c31 with i360 approval in Dec 2022.

my husband is a GREENCARD HOLDER! I applied for the ead under the c9 and was APPROVED! basically I was able to work and travel and my spouse was a LPR

@Jully T. oh wow, you answered some of my questions I longed to find out. Thank you so much. Do you have any idea that if I need to file EAD c9 extention if I have EAD card already from GC marriage? or file EAD c9 regular application? or file both c9 regular application and c31? If I can, I want to avoid paying the fee for EAD this time. Also, my I131 Travel Document has not even started to be reviewed, though I filed my GC marriage in early 2022. Should I file a new I131 Travel Document? Any thoughts will be appreciated. Thank you so much
