I am in removal proceedings, I got my EAD, I got approval of I130 and I was interviewed on i485 based on green card but the officer wrote me saying until I get terminated in court, then she can go ahead.

@olumide when was ur interview.

@Ay dot march 28 and my i130 was approved March 29.

@olumide Ajele hello bro I’m in the same situation with you just got an update that my RFe was received by uscis , I wanna can I apply for work authorization after my i130 been approved . I want you to explain more on that , really appreciate

I filed everything all together that is i130, 1485 and i785. so I got my EAD, I was later called for interview based on my i130 and i485. I was approved the next day but the officer could not approve my i485 saying it’s the Judge that can grant it except of terminated by the judge, then she can have her decision.

@olumide do u know u don’t have to wait for ur court to ask counsel and judge for joint motion to terminate, what’s ur lawyer doing on termination already.

I already ask him to do prosecutorial discretion as regards it so I don’t have to wait for the court date.

I am looking at every avenue to get off court asap.

just keep pushing ur lawyer, I always tell my lawyer what to do. they just collecting money they don’t really care especially African lawyers.

am actually using a Vietnamese but he doesn’t even know how to go about the prosecutorial discretion, so he said he will reach out to an attorney lawyer this week. he all act lazy. I will us another if he doesn’t act this week. he insisted we will go for court trial when I said I don’t want to in court for any trial when I already have my i130 approved and had no criminal records.

@olumide pls consult another attorney, ur journey just started with i130 approved no error pls. I received letter from judge last week that my proceedings dismissed I was so happy and I’ve been telling my lawyer to try it since Biden assign new EOIR chief

@mobolaji I asked my lawyer to file the motion around early last year, but am sure he don’t do something as fast as possible, I went to court 2018 and we ask counsel for termination, but she denied us due to trump-session policy, the judge didn’t have problem thou. but to be sincere I don’t know if my lawyer file it maybe I was just fortunate the counsel dropped my case due to new Biden memorandum PD

I just saw the letter from counsel to judge asking judge to dismiss the case without prejudice
