Does approval of i130 guarantee entry into the US?
Good day all. I just want to confirm if the approval of i130 guarantees that I’ll get a visa to enter US as my husband is a US citizen and we’re having a baby soon. PD is Dec 2023

@Dorcas OY Hi, it sadly does not. The border patrol officers when you arrive can deny you entry. You still need a visa to enter the US. All the I-130 does is establish a real relationship. It is not a visa nor does it grand immigrant status. It allows you to apply for a green card once in the US. If you are unable to get a visa in time and your baby is born outside of the US then your baby will also require an application and will be granted citizenship based on the parent who is a US citizen. What country are you from?

@Kingsley B thank you. I know I have to apply for visa after the i130 approval, I just want to know the approval rate for the visa and also the application to put in for my baby as my due date is close. I’m from Nigeria.

@Dorcas OY If you get the visa to enter (I just looked it up, can take a few weeks to a few months), then you would be the only one needing the visa if you get it before the baby is born and you enter the US. I hope that everything works out for you. Must be very stressful for you.
