Do you think my EAD is near?
hi guys, I just want to ask, I submitted my vawa case April and it was acknowledged as received by June 24, 2021. I just want to ask, does this mean it starts counting from date of filing or date received. thanks

i am having my 485/765/131 in MO NBC, then filed Vawa. in feb had bio, just in Sep i got update that my 485/765/131 moved to different office. i assume it is Vermont. i guess my 765/131 will take another year.

@me just me ~ I hope so. I filed for Vawa in Sept 2019. I JUST got my Vawa approved yesterday. I filed for an EAD in Feb 2020. Heard/recvd nothing from USCIS. I filed again this year. I never got an EAD, so I’m not sure what to make of that.

@pablo romero ~ Thank you. I have an atty who I raised this concern to, as my mother is a senior citizen supporting me her adult daughter. The atty’s attitude was so nonchalant. She was like, Oh….it probably got lost in the mail. OK……..don’t you think you should send another application????? She was just like, yes we can do that. I swear, if I had been in a better frame of mind, I would have filed my own paperwork, bcoz depend on others to take care of your affairs, there’s no real urgency.

@pablo romero ~ I just looked through my documents. The only things I got from the atty is the receipt notice for the I360 & one for the EAD I 765, but I just realised she’s kept all originals & given me copies. When she gets the receipt notice for the Vawa, I want my original, she can keep a copy.

@pablo romero ~ idk WHO is truly at fault. Maybe I’m wrong to blame my atty, but I do so w/just cause. She has done some pretty questionable things in the past. ie: In 2020 I wanted to know about my EAD & how I could get info as I wasn’t getting anywhere writing letters to Vermont, I was leaving her messages on her cellphone, office phone, texting her, emailing her, I even created a FB acct so I could msg her. Not once did she respond. I got the Florida bar involved as 5 months had gone by w/o responding to me & I wanted a case status. She had no choice, but to respond to me. When we did a zoom meeting, she looked me in my face & told me she didn’t have a reason for not responding to any of my messages. I was so disgusted, but what could I do? I didn’t have money to hire a new atty, as I never got an EAD! After that, she gave me a Prima Facie that was dated Oct 2020. She handed that over to me in February of 2021, saying it was late bcoz of covid. Now by this yr, things had gotten back on track, ppl were going back to work & so forth. I didn’t believe her, but what proof did I have to say otherwise? The next Prima Facie I got after that was dated April 2021 expiring in Oct 2021. I didn’t get that until July. Just 3 wks ago I text her (as she never answers my calls) to ask her if my I485 from 2018 was connected to my Vawa case. She never responded. I text her a few days later to tell her not to worry, I got my answer elsewhere. She responds w/Oh, I JUST saw your text. I no longer believe ANYTHING she says as she’s dropped the ball on my case too many times. Prime example NOT telling me about the RFE. Why wouldn’t my own atty tell me that on a Vawa case that didn’t have physical abuse & was challenging to prove?. I’m sorry, but she’s done so many questionable things in the past, I just want this to be over with already.

The crazy thing is, I found out about her when I was attending the Women in Distress facility. She was advertising there. Smh People are already in a fragile state, we don’t need the extra stress from someone that’s supposed to be helping us. Oh well, you live & you learn.

@Michael Jay ~ The RFE was for tax receipts, proof of shared residence, even though I was a participant at WID (women in distress) USCIS wanted proof of my attendance. I had to provide the number of one on one therapy sessions I attended, group sessions, what they were about, more bank statements, a psychological exam & a declaration of our routine together.

ok, i have submitted, all these documents, during my initial submission. although, I didn't submit my medical consultations. my attorney said, we should provide that if they asked.

@Michael Jay ~ Wait for the RFE on the medicals. The atty is right in that regard. Didn’t your atty tell you it takes 2yrs for USCIS to approve Vawa? When did you submit it?

almost 2years. i don't even pray they ask me to submit any medicals document. I submitted in march 2020

You will need to submit medicals. Every immigrant wanting a GC will have to submit one. It’s nothing intrusive. It’s pricey though. When I was looking for a dr to do mine, I did a lot of research because the prices were CRAZY! Some drs wanted up to $800 which is a rip off. I ended up paying $300 for the actual exam. Thank goodness my mother never throws anything away. I have a vaccination book which shows which vaccines I already received as a child. I ended up getting a 2 part injection from Walmart 30 days apart. Each costing $114. There’s a clinic that I know about that does STD testing for free. I was able to get my report from them to show the dr so he didn’t have to perform them on me therefore, no extra charging. hth

Have you had the Covid vaccine or the Flu shot? I believe that USCIS wants anyone wanting a GC needs to have them unless they have a religious or medical issue that would exclude them from getting it.

That wasn't the medical, I was referring to. I have done all the vaccine and done , I have submitted my family base application before went left with my ex. I was talking about the mental health and psychological sections I had.

@Michael Jay ~ I’m sorry, it’s early in the morning for me. I’m still not following you. Are you saying that you’ve already completed the psychological evaluation or you have not? If your Vawa case is lacking physical abuse, police reports, or friends/witnesses willing to write declarations on your behalf, the psychological evaluation WILL boost your case. I wish you luck.

@ KP .They didn't tell me, I have completed psychological evaluation but was told I can schedule an appointment as needed. I have friends and my mom was around in one of the event, so she wrote a witness declaration and a friends was once on phone In another event, money I planned to used for professional exam was withdrawn without my notice in our joint account. I have police report for good character and other evidences. attorney asked me hold with any psychological report or attended, until they request.

Okay, so just go w/the advice of your atty. I only mentioned the evaluation, as the report will show that a professional believes that you actually suffered from mental anguish. As I said before, I completed my evaluation in 2019. Even though I had one on one counseling & attended group therapy at Women in Distress, it wasn’t enough for USCIS. I later included the evaluation in the RFE this yr along w/other documents now my case is approved. Hope all works out for you.
