Denied after PP?
So my case is one of those that fell behind the adjucator’s desk 😅
My PD is Aug/23, received a RFE on Nov/23 and responded on Feb/24, since then completely silent. I even made an inquiry on Oct/24 but got the same response as everyone else.
My case is current as of today, my question is, is it worth it to go for PP?
I know that some people just would answer to go for it, but just for reference the fee today it almost worth 2 month salary in my currency. Not to mention the fear of getting denied after PP.
Has anyone received a denial after PP?

there’s no evidence for PP increases the chance of denial or RFE. If you receive a denial after PP it’s likely you would be denied anyway. upgrading to PP is a personal decision that you have to consider multiple factors specific to you. How much you need that money, how long you can wait, etc

Yes! Some have been denied after upgrading to PP. You should make a case inquiry and see if you get a decision

I think it’s possible to file i485 once your Pd is current even with pending i140. it passes for concurrent filing.

If I were you, I won't go for PP, especially you are not in the US and this PP is for RFE that you have been issued before. So, rather than spending times 2 of your monthly salary on something you are not sure you will get approval for, why not restrategize and see if you can spend that money on a new petition like EB1 if you have the money.

@Anu O if @Lucas EB is current now even if he’s outside the US, why no apply to PP ? if he got approved, he can continue the application through consular process , he’s Aug/23 and last action is Oct/15/2023, he’s opportunity is now … and @Lucas EB try to call to USCIS what’s going on your case , before apply for PP

@Lucyeta OC you are right and he can apply for PP, My opinion is it would be better if he hasn't gotten RFE before and he is doing the PP for his petition prior to the RFE. The chances of getting approved after being issue an RFE is 50-50 and also depending on what the RFE entails. I wish you all the best @Lucas EB
