Not quite sure. I put in two expedite, one through congressman and one through Emma. After 30 days, uscis reached back to congressman man to ask me to send proof of hardship...which I did about 5 days ago and still waiting for an approval or denial now. The expedite request through Emma never got a response back after 30 days so I'll probably put another one.

Our case is outside of normal processing time. We haven’t been able to get a response to service request for outside normal processing time. But when contacted through congresswoman, they got the response that it will be put in expedited queue - this was six weeks ago.

was your expedite approved?

the email from congresswoman office says it’s in the queue. does that mean it’s accepted? I tried Emma live agent but they kept exiting chat and told that we should check processing time web page.

@s k in means it's inline to be reviewed. In other words means "nothing." From the time you expedite it can take about 2-8weeks for USCIS to ask for additional evidence. After they receive the evidence, they will make a decision to either approve or deny your expedite. If your expedite is approved it can take 1 week to another 8 weeks for them to approve your case. In other words your expedite approval and case approval can take from 2 weeks to 3 months in total.

thank you for explaining @William u. will this effect timeline for AOS? I don’t understand why they didn’t issue the AP along with EAD. My mom got both at the same time. Dad got EAD but no AP.

@s k It will not affect your progress, submitting inquiries and requesting expedite could actually help the overall process but not guaranteed. I understand some people get the combo card, but they don't see AP as a priority for someone who going through the green card process. USCIS wants to adjudicate EAD first.

ah ok. thanks again @William u . my dad’s I130 has actively reviewing since Jun 2023 that’s around the time he got his EAD. Mom got EAD and AP in Jun 2023 but her I130 status says application received on Jul 2022. I wonder if actively reviewing on I130 is why he didn’t get AP. Also the response to congresswoman inquiry said dad’s application identified as potential interview waiver so will be routed to non local field office. But no definite timeline. Is that good news?

@NH O - what is considered hardship? What evidence can we provide? for example, in our case no one to look after house back in home country (taxes, etc). how do we provide evidence for that?

@s k show any financial documents to show that you owe money, or proof that you own the house in your home country and you need to look after it financially.....or anything like overdraft from your bank etc. if you're seriously struggling with bills then there will probably be something like overdue balance, eviction threats, late payments of phone bill, late payments for utility...things like that.

@William u HI, so my congressman office reached back to me on my ead expedite case after a month of me applying through the congressman's office. They basically said uscis wanted me to send send proof of hardship through email to the congressman, which would then be forwarded to uscis. I already did that last Thursday (16th). What do you think is next ? and how much longer do you think it would take to hear back ?

@s k Interview waiver is good news, meaning no "interview". :-) Have you chatted online through EMMA? You can ask about your dad's case there also.

@NH Expedite reviews take about 1-4:weeks to see if the "expedite" is approved. once approved it take another week or 2 to have your EAD approved. Good Luck!

@William u , thank you! yea, I tried Emma live chat a few times. Recently when I ask about I131, the agents exit the chat and tell me check processing time on website. Next we’ll try asking about I485.
