counselor case
Hello everyone
My family member applied for Eb3 back in 2022 June as a counselor applicant. His Labor and I-140 were approved a while ago and also currently documents qualified. Today his lawyer informed him that employer doesn't want to continue the process. what are the options available for him? other than just filing everything from start?

is his i140 approved over 180days ?
OR did he file for i485? if yes, is this pending over 180 days
if he qualified one of these 2 above then he can file I485J for new employer as long as the job is similar or same to the original one then continue with his case normally.

zuki is right - I believe an employer can’t withdraw I-140 after 180 days. if they do, 485J can be used with the new employer. please do consult a lawyer to confirm as your situation may vary . have specific questions written down before the appointment so you don’t waste time and spend extra $$$ beyond a one hour consultation
