Confusing response from USCIS
Below is the response that attorney received for the service request.
The status of this service request is:
"Recently, you contacted us to update your priority date. Your priority date, 4/10/2020, is the priority date we have on file.
The priority date 7/23/2024, on the I-485 notice reflects the date we received your Form I-485 application and is used to establish date order for processing.
Once your priority date is current and an immigrant number becomes available to you, USCIS will resume processing your application. Applications will be worked in the order in which it was received. Your priority date can be found on Form I-797, Notice of Action, for the petition filed for you."
What does this mean - my PD is 4/10/2020 or 7/23/2024? As per current bulletin, 4/10/2020 is always current. Anyone else has similar experience?

Thank you helen for the clarification. Original priority date was from previous EB2 application. I recently filed EB1 with PD from EB2 application.

@helen helen - if the visa number is not available shouldn't the dates have retrogressed. my be lqck of my understanding - doesn't PD current means that there would be a Visa number available?

@saurabh gupta there’s no issue here - your priority date is 4/10/2020 as mentioned in the second sentence of the first paragraph . the 7/23/2024 is your application submission / receipt date that’s used for processing . 4/10/2020 is your priority date and will be used to determine whether or not your case remains current .

@saurabh gupta yes priority date remaining current means visa will be available. otherwise they usually update the case to “case remains pending “ status . as long as your status shows “case is being actively reviewed “ you are good. but good that you checked about priority dates . in my case my priority dates were swapped with receipt date based on USCIs response .

hi @saurabh gupta , I am in the similar situation. my PD is 07/2020, but on my account acceptance notice priority date is mentioned as the same date as 485 receipt notice(12/2024). when I checked with attorney, he said not to worry. how did you raise the service request?

@lk s what’s the priority date in your I-140 has it been approved yet ? my lawyer told me the same thing - the priority date on the I-140 approval notice is the correct one . normally if PD is not current they reject the application or return it - we do not get an acceptance . I guess we all just have to be patient and wait .

@saurabh gupta - when was your I485J approved? pleass try to call USCIS and demand that you need to speak to a Tier 2 officer, i.e ISO to know the exact reason as to why your Case Remains Pending status even though your PD is current

the only reason it could happen is your case is all set to be approved by the case officer, but a visa number may not be immediately available, but you should defenitely speak to Tier 2 officer

it is also possible they will approve petitions in 2015 to 2020 before they can come to your case. there is a lot of EB1 petition in review status for those years

@S N - are the visa numbers made available on monthly basis? Pls excuse me for my limited knowledge but shouldn't the dates retrogress in that case.

@saurabh gupta - even i am.not too sure of the process i.e how the visa numbers are calculated on monthly basis, but reading from reddit forums, looks like if there is some other applicant whose priority date is before you in EB1, its reserved for them and in the order of priority date visa number is allocated, but i agree with you then the dates should have retrogressed, but looks lile its very common, you should get approval soon

My PD is Oct 21 and is currrent since July 2024. I am still waiting for action on my case. case went pending in 2023 when dates for EB1 were retrograced. as per visa bulletin and information on USCIS an applicant has visa number available that month if their PD is current as per visa bulletin. only issue is officer has to get to the file for adjudication but they have so much workload so not sure how it get picked
