Confused and don't know what to do. pls help
I filed my I-751 June 2021 which is still pending then I went ahead to file N-400 under the 3 years rule n still pending . the issue is I have been going through abuse in my home since 2019 and 2021 Jan I starting seeing a therapist cause I was going crazy n depressed.
now I am worried uscis might call for a combo interview and my spouse will definitely not show up. I don't know what to do.
should I file for weaver based on abuse we n with the N-400. or should I file for waiver based on abuse n divorce and then with the N-400 . or mayb I should leave everything as it is and wait for the combo interview and show my evidence at that time.?
please I need advice đ

i would like to help you . might be someone here can help you on this .. in case you dont find a proper answer . get a lawyer even a cheap one . cause this sound that you need a good answer .

I'm so sorry for what you are going through. I don't have an answer for you unfortunately but as Lejla said, I think it's best you consult with a lawyer.

@God's Time Sorry about what you are going through. As long as you have that N-400 on file, you will definitely get an interview. If you show up to that interview without your spouse, both cases will most likely be denied. My advice is that you should work on your marriage and if it becomes apparent that your marriage has failed, withdraw that N-400 and convert your I-751 to a divorce and abuse waiver. You will be needing a divorce decree so try to finalize your divorce. You have to be living in martial harmony with your spouse for an N-400 filed under the three year rule to be approved.

First get a lawyer.... pay with a credit card if you have to. If u have a pending N400 u must make sure your marriage is in order otherwise u need to withdrawal the N400.... but a lawyer should help
