Child born in abroad while waiting for my spouse’s I130 approval (F2A)
PD : Jan 2024 Category : F2A (I’m a green card holder) And we just had a baby 2 months ago, how can I add baby so that baby and my wife will immigrate together? USCIS website is not clear about this scenario. Do we have to file separate I130? Has anyone gone through this similar situation?

from what I heard, since your wife's F2A I-130 is pending, you cannot add your newborn to it. You must file a separate I-130 immediately for the baby with the birth certificate showing you as the parent. Once both petitions are approved, the NVC usually keeps them together, so your wife and baby can immigrate at the same time. Filing the baby’s petition promptly ensures they stay together during processing.

don’t do anything after approval I-130 . you can add your child on Nvc stage I am in same situation pd was may 2023 and waiting for approval than I will add my child on Nvc stage

after approval,add your child ...Do not file anything.Your child will be a derivative beneficiary,and will immigrate with the mom ..

I understand we can add but my spouse I130 is still pending and it has not approved yet. While I’m waiting now I130 to be approved, We just had a baby 2 months ago. Can we still add baby in nvc stage without I130 for my baby?

Is there any harm to file I130 even if I will not naturalize before my spouse and my child gets to US? I just want to be safe in the future so my child and my spouse can come together to US.
