Changing regular I-140 to premium
My I-140 has been pending for 8 months, can I now change it from regular to premium processing. Any pros and cons of doing it? Any impact it would have on I485 processing? Detail: concurrent EB-1 filing.
Thank you!

It would help you get your Green card faster. The I-140 has to be approved first before the I-485 is approved. Cons is the cost of it. Also note that the processing time for the I-140 is 8 months to 13.5 months, implying that they should be processing yours shortly if you keep it under regular processing.

premiums are most likely to her RFE

My I-140 pending just turned 1 year and still waiting. so, not sure if will be faster with regular.

are you in that category coz like EB1C is not allowed for premium processing it’s worth going for it

Pay it! if you can go for it. I waited for 8 months and paid for PP of I-140. One month later I received a bio appointment. It could be related who knows. However, it will speed up the 485 application. Go for it If you can!

Is EB-2 allowed to do premium?
Graceful ManJan 12, 2022
you will get the answer in 15 days and it’s worth paying PP of your category allow

Teodora I do not know. I am an EB3-1 category and it was available for me. I strongly encourage everyone who is able to pay for premium processing.

@rehan: So my category is EB1C. does that mean I am not eligible to file for PP or amend the existing I-140 to switch from regular to premium?
A PJan 12, 2022
@Uros: Since you were EB category, did you reimburse your employer for the cost or did you pay directly to USCIS?

@eb1bil: Texas service center, filed in April 2021 end in EB1C by my employer
Uros JovanovicJan 12, 2022
AP , my employer agreed to pay for premium. But you can reimburse your employer.

as Rehan said EB1C does not have the PP option 😞
Uros JovanovicJan 12, 2022
Sorry to hear that. Hang in there!

anyone know why EB1C doesn’t allow PP? just curious 🧐
Graceful ManJan 13, 2022
no idea but it’s under the approval process hopefully soon the PP will be allowed

because they gotta really dig EB1C cases for approvals and they can't do it in a split second like other cases. I'm still worried what 2020 cases are abandoned at Texas. maybe the office has lot paper trail? I mean seriously, like why would they almost stopped 2020 but 21 going full speed.
Katerina dzJan 14, 2022
@MA ok, but why in this logic EB1A has PP, which considers to be the toughest case type

@Kat, you’re right. I was wrongs. I am sure you know NIW doesn’t have PP too. I can come up with a few plausible theories on the reason for Texas slowdown though. H1B revenue one of them.
