change consular to adjust status
i130 is approved we are currently at nvc dq
my question is, if my husband got a tourist visa on march 2023 and he is here right now can we change to adjust of status, I wouldn’t like him to leave, the line in Mexico is too long, I would like to know if there would be any problems since it’s his first time coming here, we got married a year and a month ago, thanks for the reponses

I wanted to do the same as you, but I think it’ll just delay your process because you’ll have to explain to Nvc what happen and also uscis

and to apply for adjustment of status your husband has to stay in the country for at least 90 days before applying to adjust

I’m in this process right now, also from a tourist visa
i130 approved in May 2022, i485 filed July 2022 and to this day I don’t ead, ssn or anything

i believe the 90 day rule got removed tho, that’s what a lawyer said, @Lisa López and thats only if you’re getting married inside the us with the tourist visa, @Anastasia C you should ask uscis cause everyone gets the ead like in a month from what I see

@jsjsj nsbsb yes, I’ve seen, but ead in my category shows 11,5 months to get so my case is within normal processing and there isn’t much I can do
I just wanted for you to stay cautious bc all cases are different and you should be ready for any outcome (like mine - sitting for a year, without being able to apply for a dl in my state, go home, work and other😞)
