case remains pending.
need some help. my PD is October 29, 2021. filed my AOS under EB3 rest of the world. my PD is current, however the status of my case is pending because of unavailability of visas. has this happened to any one else. what exactly does the mean?

where are you from? Could it be possible that they have run out of visa for your nationality? Although you are EB3 ROW, the USCIS allocates 7% for each country under the EB visa. This means if they have used up all the 7% of visa allocation for your country, they will have to wait till the next fiscal year, hence the status shows that your case remains pending due to visa unavailability.

I filed my i485 along with my wife. since her country of birth is Saudi Arabia, we requested that our cases be charged against Saudi Arabia, rather than India.

@Saher Mohammed then it's possible that they have run out of visas for the 7% allocated to Saudi Arabia for this fiscal year.

@T C I highly doubt that for Saudi Arabia their 7% quota is over

I did call the USCIS contact center and spoke to Tier1 officer. They were not not sure about the cross chargeabilty and could not say whether my case was being charged against Saudi quota or Indian quota. They did create a service request and said the Tier 2 office review the service request and get back to be in about 30 days.

I filed my I-485 in Jan 2021 I just received my Green card last week. I too had the same issue they didn’t know exactly about cross chargeability. I tried calling and they created many service request but there was no solution to it. Finally I tried to contact the congressman’s office that will help. If they enquire about ur case they will definitely reply.

@Glo Geo congratulations for getting approved. yes, I did the same thing. I contacted my congressman and filled out a privacy form. they have submitted my inquiry and asked me to wait for couple of weeks for uscis to respond. btw, after your took your congressman’s help, how may weeks did it take to get your green card.
