if your petitioner is already living in the us you can file from 485 adjusting status in the United States. the from 824 is for dose outside us that coming with immigrant visa so that they can sent the I-130 approval to NVC. for visa in they country.

@Sara L yes!!! my 130 was approved last year in April. I got the confirmation for the service request and they are going to email me back in 10 business days. I am still waiting for it. Did you upgrade already???

@y J I was also told that they will get back to me in 10 business day by email or phone call back on May 20th, but I didn’t hear anything back. They emailed me that I do not need to contact them again. I also called them and they told me to wait. They said that only 130 can be upgraded and for 485, there will be no confirmation letter for upgrading. My case did move to the local office, so I assume that I am waiting for the interview schedule. Update me when you hear anything back!

did you also submit out of processing time? after I request it, they emailed me back on June 7th, they are going to reach out to me in 60 days.

Hey! anything from them? looks like my field office did not upgrade my case. they reponded the inquiry for the upgrade that they cannot give me GC since I am F2A. they don’t even read my inquiry

@y J I had the same experience. They asked me to send a written request instead and then I did so. Then they told me to keep waiting. I contacted them again and they said that my case has been upgraded

how long after it happened? did you send it to your field office?

Yes, I sent it to the Brooklyn field office
